A. Fees Established: Unless fees are waived or reduced pursuant to subsection C of this section, each person requesting information pursuant to the Illinois freedom of information act shall pay the following fees for copying, certification, and mailing of public records:
1. Copies (81/2 x 11), as set out in section 1-12-3 of this title, under the category "administrative fees".
2. Copies (oversize), as set out in section 1-12-3 of this title, under the category "administrative fees".
3. Certification, as set out in section 1-12-3 of this title, under the category "administrative fees".
4. Mailing, the current postage rate as determined by the United States post office.
B. Method And Time Of Payment: Payment of all required fees must be made in cash, by cashier's or certified check, or by money order prior to the examination, copying, or certification of any public record.
C. Waiver Of Fees:
1. The fees provided in subsection A of this section may be waived or reduced by the village administrator if the person requesting information pursuant to the Illinois freedom of information act states the specific purpose of the request on the request form filed at the time of the request and establishes to the reasonable satisfaction of the village administrator that a fee waiver or reduction would be in the public need. Any request for fee waiver or reduction must be indicated on the request form filed at the time of the request.
2. A fee waiver or reduction shall be considered to be in the public interest only if the principal purpose of the request is to disseminate information regarding the public health, safety, and welfare or the legal rights of the general public and is not for the principal purpose of personal or commercial benefit to the person requesting information pursuant to the Illinois freedom of information act. The village administrator may consider the number of requested public records and the cost and necessity of copying the records in setting the fee waiver or reduction amount. (2009 Code)
