8-2-2: DEFINITIONS:
As used in this Title, the following words and terms shall have the meanings ascribed to them in this Chapter:
ACCESSORY STRUCTURE: A structure detached from a principal building on the same lot and customarily incidental and subordinate to the principal building or use.
ACCESSORY USE: A use of land or of a building or portion thereof customarily incidental and subordinate to the principal use of the land or building and located on the same lot with such principal use. Beehives and apiaries shall be a permitted accessory use in any R-1, R-2, or R-5 Residential Zoning District or a permitted use in any Agricultural Overlay Zoning District, but only in compliance with the terms, conditions and restrictions of Chapter 3, "Animal Control" , of Title 4, "Police Regulations", of this Village Code.
ACRE: Forty three thousand five hundred sixty (43,560) square feet.
ADDITION: A structure added to the original structure after the certificate of occupancy has been issued for the original structure.
ADULT ENTERTAINMENT CABARET: A public or private establishment which is licensed to serve food and/or alcoholic beverages, which features topless dancers, go-go dancers, exotic dancers, strippers, male or female impersonators or similar entertainers.
ADULT MINI-MOTION PICTURE THEATERS: An enclosed building with a capacity for less than fifty (50) persons used for presenting materials distinguished or characterized by an emphasis on matter depicting, describing or relating to specified sexual activities or specified anatomical areas for observation by patrons therein.
ADULT MOTION PICTURE THEATER: An enclosed building with a capacity of fifty (50) or more persons used for presenting material distinguished or characterized by an emphasis on matter depicting, describing or relating to specified sexual activities or specified anatomical areas for observation by patrons therein.
ADULT STORE: An establishment having as any portion of its stock and trade, for sale, for rent and/or for exhibition on or off the premises, books, magazines, periodicals, photographs, films, videos, other forms of recording or media, paraphernalia and/or other products which are distinguished or characterized by their emphasis on matters depicting, describing or relating to specified sexual activities or specified anatomical areas; provided, however, that in the event such items do not exceed ten percent (10%) of the retail space in such establishment and are visually and spatially separated from the main part of the retail space open to the general public, then such use shall be considered an accessory use to the principal retail use of the establishment.
ADULT USE CANNABIS: Cannabis which is sold, purchased, possessed, and used in compliance with the Cannabis Regulation and Tax Act.
ADULT USE CANNABIS BUSINESS ESTABLISHMENT: A cultivation center, craft grower, processing organization, dispensing organization, and/or transporting organization as those terms are defined in the Cannabis Regulation and Tax Act as said Act may be amended from time to time, and which are or may be licensed and/or otherwise regulated pursuant to said Act.
ADULT USE CRAFT GROWER: A facility operated by an organization or business that is or may be licensed by the Illinois Department of Agriculture pursuant to the Cannabis Regulation and Tax Act to cultivate, dry, cure, and package cannabis and perform other necessary activities to make cannabis available for sale at a dispensing organization or use at a processing organization.
ADULT USE CULTIVATION CENTER: A facility operated by an organization or business that is or may be licensed by the Illinois Department of Agriculture pursuant to the Cannabis Regulation and Tax Act to cultivate, process, transport (unless otherwise limited by the Cannabis Regulation and Tax Act), and perform other necessary activities to provide cannabis and cannabis-infused products to cannabis business establishments as defined in the Cannabis Regulation and Tax Act, as said Act may be amended from time to time.
ADULT USE DISPENSING ORGANIZATION: A facility operated by an organization or business that is or may be licensed by the Illinois Department of Financial and Professional Regulation pursuant to the Cannabis Regulation and Tax Act to acquire cannabis from a cultivation center, craft grower, processing organization, or another dispensary for the purpose of selling or dispensing cannabis, cannabis-infused products, cannabis seeds, paraphernalia, or related supplies as defined in the Cannabis Regulation and Tax Act, as said Act may be amended from time to time.
ADULT USE INFUSER ORGANIZATION OR INFUSER: A facility operated by an organization or business that is or may be licensed by the Illinois Department of Agriculture pursuant to the Cannabis Regulation and Tax Act to directly incorporate cannabis or cannabis concentrate into a product formulation to produce a cannabis-infused product.
ADULT USE PROCESSING ORGANIZATION OR PROCESSOR: A facility operated by an organization or business that is or may be licensed by the Illinois Department of Agriculture pursuant to the Cannabis Regulation and Tax Act to either extract constituent chemicals or compounds to produce cannabis concentrate or incorporate cannabis or cannabis concentrate into a product formulation to produce a cannabis product.
ADULT USE TRANSPORTING ORGANIZATION OR TRANSPORTER: An organization or business that is or may be licensed by the Illinois Department of Agriculture pursuant to the Cannabis Regulation and Tax Act to transport cannabis on behalf of an adult use cannabis business establishment or a community college that is or may be licensed under the Community College Cannabis Vocational Training Pilot Program pursuant to said Act.
ADVERTISING DISPLAY AREA: The surface area encompassed within any regular geometric figure which would enclose all parts of the sign not including structural supports.
AGRICULTURAL LAND: A tract of ten (10) acres or more not composed of subdivision lots and used for purposes of agriculture.
AGRICULTURE: The production, keeping or maintenance for sale, lease or personal use of plants and animals useful to humans, including, but not limited to: forages and sod crops; grains and seed crops; dairy animals and dairy products; poultry and poultry products; livestock, including beef cattle, sheep, swine, horses, ponies, mules or goats, or any mutations or hybrids thereof, including the breeding and grazing of any or all of such animals; bees and apiary products; fur animals; trees and forest products; fruits of all kinds, including grapes, nuts and berries; vegetables; nursery, floral, ornamental and greenhouse products or lands devoted to a soil conservation or forestry management programs.
ALLEY: A public right of way primarily designed to serve as a secondary means of vehicular access to the side or rear of those properties whose principal frontage is on a street.
ALTERATION: Any change or rearrangement in the supporting members of an existing building, such as bearing walls, columns, beams, girders or interior partitions, as well as any change in doors or windows, or any enlargement to or diminution of a building or structure, whether horizontally or vertically, or the moving of a building or structure from one location to another.
ANIMAL USES, NONVETERINARY: Uses related to nonveterinary dog and/or cat care, including, but not limited to, dog and/or cat kennels, dog and/or cat daycare or day boarding, and dog and/or cat training.
APIARY: A place where bees are collected, consisting of one or more beehives.
APPLICANT: Any person, firm, corporation or agency which submits an application.
APPLICATION FOR DEVELOPMENT: The application form and all accompanying documents and exhibits required of an applicant for development review purposes.
APPLICATIONS: This term shall mean the following:
   A.   Petitions for annexation to the village;
   B.   Petitions for special use permits and for zoning or rezoning of property within the village;
   C.   Applications for building and/or grading permits on property within the village; and
   D.   Applications for approval of plats of subdivision or planned developments on property within the village or the unincorporated area of Lake County within one and one-half (11/2) miles of the planning boundaries of the village.
APPROVED COMBUSTIBLE MATERIAL: Any material more than five one-hundredths inch (0.05") thick which burns at a rate of not more than two and five-tenths inches (2.5") per minute when subjected to the American Society for Testing Materials test for flammability in sheets of six one-hundredths inch (0.06") thick.
ARMORING: A form of channel modification which involves the placement of materials (concrete, riprap, bulkheads, etc.) within a stream channel or along a shoreline to protect property above streams, lakes and ponds from erosion and wave damage caused by wave action and stream flow.
AWNING: A structure with a frame attached to a building and projecting from the building capable of being raised or retracted to a position against the building when not in use.
AWNING SIGN: A sign attached to, painted on or incorporated in any awning, canopy or marquee.
BANNER: A temporary sign consisting of a piece of fabric or other flexible material attached to two (2) or more pole(s) or staff(s) or line(s).
BASEMENT: A space having one-half (1/2) or more of its floor to ceiling height below the average level of the adjoining ground and with a floor to ceiling height of not less than six and one-half feet (61/2').
BEACON LIGHT: Any light with one or more beams capable of being directed in any direction or directions or capable of being revolved automatically.
BEDROOM: A private room planned and intended for sleeping separable from other rooms by a door and accessible to a bathroom without crossing another bedroom or living room.
BENCH SIGN: A sign located on any part of the surface of a bench or seat placed on or adjacent to a public right-of-way.
BERM: A mound or bank of earth or soil and/or a combination of earth or soil and other approved fill, whether existing naturally as part of the topography of a lot or parcel or intentionally constructed or created, and usually used as a barrier to control surface water runoff, and/or as a barrier to provide visual screening or sound attenuation.
BILLBOARD: Any sign, whether temporary or permanent, erected on private property or attached to any building on private property which relates to a business, profession, occupation, service, building, activity, or use not conducted or offered on the premises to which such sign is annexed or attached.
BOARD OF APPEALS: The Zoning Board of Appeals of the Village of Lake Barrington, Illinois.
BOARDER: An individual other than a member of the family occupying the dwelling unit or part thereof who, for a consideration, is furnished sleeping accommodations and may be furnished meals or other services as part of the consideration.
BOARDING HOUSE: A dwelling or part thereof in which lodging is provided by the owner or operator to more than three (3) boarders.
BOARDING STABLE: A structure designed for the feeding, housing and exercising of horses not owned by the owner of the premises.
BUFFER STRIP: Land area used to visibly separate one use from another or to shield or block noise, light or other nuisances.
BUILDABLE AREA: The area of a lot remaining after the minimum yards, open space, easements and flood plain requirements have been met.
BUILDING: A structure that is principally above ground and is covered by a roof. The term includes any structure intended for the shelter, housing or enclosure of any individual, animal, process, equipment, goods or materials of any kind. The term includes a gas or liquid storage tank, a manufactured home or a prefabricated building. This term also includes recreational vehicles and travel trailers to be installed on a site for more than one hundred eighty (180) days.
BUILDING COMMISSIONER: The Building Commissioner of the Village.
BUILDING, DETACHED: A building surrounded by open space on the same lot.
BUILDING HEIGHT: The vertical distance of a building measured from the average elevation of the finished grade within twenty feet (20') of the structure to the highest point of the roof, excluding penthouses, containing mechanical equipment such as air conditioning or elevator equipment and church spires, water towers and radio antennas.
BULK STORAGE: The storage of chemicals, petroleum products and other materials in aboveground containers.
BULKHEAD: A retaining wall that protects property along water.
CANNABIS REGULATION AND TAX ACT: Illinois Public Act 101-027, as may be amended from time to time.
CANOPY: Any structure, other than an awning, made of cloth, metal or other material with frames attached to a building and carried by a frame supported by the ground or sidewalk.
CAR SIGN: An advertising or business sign attached to an operable or inoperable motor vehicle, van, or trailer which is parked or placed, in position where it is displayed to the public.
CARPORT: A roofed structure providing space for the parking or storage of motor vehicles and enclosed on not more than three (3) sides.
CARRY-OUT RESTAURANT: An establishment which by design of physical facilities or by service or packaging procedures permits or encourages the purchase of prepared ready-to-eat foods intended primarily to be consumed off the premises.
CHANGE OF USE: Any use which substantially differs from the previous use of a building or land.
CHANGEABLE COPY SIGN: A sign that is designed so that characters, letters or illustrations can be changed or rearranged without altering the face or the surface of the sign.
CHILDCARE CENTER: A private establishment enrolling four (4) or more children between two (2) and five (5) years of age and where tuition, fees or other forms of compensation for the care of the children is charged and which is licensed or approved to operate as a childcare center.
CHURCH: A building or structure, or groups of buildings or structures, which by design and construction are primarily intended for the conducting of organized religious services and associated accessory uses.
CLINIC: An establishment where patients are admitted for examination and treatment by one or more physicians, dentists, psychologists or social workers and where patients are not lodged overnight.
COMMISSION: The plan commission of the village.
COMPASSIONATE USE ACT: The compassionate use of medical cannabis pilot program act, public act 98-0122 in force beginning January 1, 2014, or as said act may hereafter be amended from time to time.
COMPREHENSIVE PLAN: The official comprehensive plan of Lake Barrington, Illinois, and environs, being the official plan of the municipality, as adopted and amended.
CONDITIONS: The provisions, restrictions and limitations imposed upon a building, structure or parcel of land at the time the board of trustees grants a variation, amendment or special use.
CONDOMINIUM: A building, or group of buildings, in which units are owned individually and the structure, common areas and facilities are owned by all the owners on a proportional, undivided basis.
CONSTRUCTION SIGN: Any sign giving the name or names of principal contractors, architects and lending institutions responsible for construction on the site where the sign is placed together with other information.
COUNTRYSIDE UNIT: A parcel of land meeting the requirements set forth for the countryside overlay zoning district.
CULVERT: A structure designed to carry drainage water or small streams below barriers such as roads, driveways or railway embankments.
DECIBEL: A logarithmic unit of measurement which defines the range of sound pressure levels (Lp) between the minimum audible value at one thousand (1,000) cps and the maximum audible value of Lp, at which effects other than hearing begin to appear.
DENSITY: The number of families, individuals or structures per unit of land.
DEVELOPMENT: The carrying out of any building, agricultural or mining operation or the making of any change in the use or appearance of land and the dividing of land into two (2) or more parcels. The following activities or uses shall be taken, for the purposes of this Title, to involve development:
   A.   Any construction, reconstruction or alteration of a structure to occupy more or less ground area or the on-site preparation for same;
   B.   Any change in the intensity of use of land, such as an increase in the number of dwelling units on land or a material increase in the site coverage of businesses, manufacturing establishments, offices and dwelling units, including mobile homes, campers and recreational vehicles, on land;
   C.   Any agricultural use of land including, but not limited to, the use of land in horticulture, floriculture, forestry, dairy, livestock, poultry, beekeeping, pisciculture and all forms of farm products and farm production;
   D.   The commencement of drilling, except to obtain soil samples, or the commencement of mining, filling, excavation, dredging, grading or other alterations of the topography;
   E.   Demolition of a structure or redevelopment of a site;
   F.   Clearing of land as an adjunct of construction for agricultural, private residential, commercial or industrial use;
   G.   Deposit of refuse, solid or liquid waste, or fill on a parcel of land, or the storage of materials;
   H.   Construction, excavation or fill operations relating to the creation or modification of any road, street, parking facility or any drainage canal or to the installation of utilities or any other grading activity that alters the existing topography;
   I.   Construction or erection of dams, levees, walls, fences, bridges or culverts; and
   J.   Any other activity that might change the direction, height or velocity of flood or surface waters.
Development does not include maintenance of existing building and facilities such as reroofing or resurfacing of roads when there is no increase in grade, or gardening, plowing and similar agricultural practices that do not involve filling, grading or construction of levees.
DIGITAL SIGNS OR DIGITAL DISPLAY: A sign or display that includes a lit electronic presentation in the form of characters such as numbers, letters, and graphics, including, but not limited to, cathode ray tube, LED, LCD, neon, plasma, and similar signs or displays.
DIRECTORY SIGN: A sign on which the names and locations of occupants or the use of a building is given. This shall include office buildings and church directories.
DISTRICT: A part, zone or geographic area within the Village within which certain zoning or development regulations apply.
DISTRICT BOUNDARY LINE: A line which marks the separation between two (2) zoning districts.
DRAINAGE: A. Surface water runoff; or
   B.   The removal of surface water or ground water from land by drains, grading or other means which include runoff controls to minimize erosion and sedimentation during and after construction or development, the means for preserving the water supply and the prevention or alleviation of flooding.
DRUG STORE: A store where the primary business is the filling of medical prescriptions and the sale of drugs, medical devices and supplies and nonprescription medicines but where nonmedical products are sold as well.
DUMP: A land site used primarily for the disposal by dumping, burial, burning or other means and for whatever purpose of garbage, sewage, trash, refuse, junk, discarded machinery, vehicles or parts thereof and other waste, scrap or discarded material of any kind.
DWELLING: A structure or portion thereof which is used exclusively for human habitation. Where a private garage is structurally attached, it shall be considered as a part of the building in which the dwelling is located.
EASEMENT: A grant of one or more of the property rights by the property owner to and/or for the use by the public, a corporation or another person or entity.
ELEVATION CERTIFICATES: A form published by the Federal Emergency Management Agency that is used to certify the elevation to which a building has been elevated.
EMINENT DOMAIN: The authority of a government to take or to authorize the taking of private property for public use.
ENCROACHMENT: Any obstruction in a delineated floodway, right-of-way or adjacent land.
ENFORCEMENT OFFICER: The person appointed by the Village Board of Trustees to enforce this title.
ENVIRONMENTALLY-SENSITIVE AREA: An area with one or more of the following characteristics:
   A.   Slopes in excess of fifteen percent (15%);
   B.   Floodplain;
   C.   Soils with a high water table;
   D.   Land incapable of meeting percolation requirements;
   E.   Land formerly used for landfill operations or hazardous industrial use;
   F.   Fault areas;
   G.   Stream corridors;
   H.   Estuaries;
   I.   Mature stands of native vegetation; or
   J.   Aquifer recharge and discharge areas.
EQUINE: One horse, pony, mule or ass.
ERECT: For the purposes of the sign regulations, to build, construct, attach, hang, place, suspend or affix. Also includes the painting of wall signs.
EROSION: The general process whereby soils are moved by flowing water or wave action.
ESSENTIAL SERVICES: The erection, construction, alteration or maintenance of underground, surface or overhead electrical, gas, steam, water and sewerage transmission and collection systems and the equipment and appurtenances necessary for such systems to furnish an adequate level of public service.
EXEMPT SIGN: A sign not requiring a permit or a fee pursuant to this title. All other signs are "non-exempt".
EXISTING USE: The use of a lot or structure at the time of the enactment of the ordinance codified in this title.
FACADE: The exterior wall of a building exposed to public view or that wall viewed by persons not within the building.
FACTORY: A building in which semifinished or finished materials are converted to a different form or state or where goods are manufactured, assembled, treated or processed.
FAMILY: An individual or two (2) or more persons related by blood, marriage or legal adoption living together as a single housekeeping unit within a dwelling unit including foster children and domestic servants. Family shall also include two (2) unrelated persons.
FARMING: The use of land for agricultural purposes, including agriculture, floriculture, forestry, grazing of dairy animals, greenhouses, hatcheries, horticulture, nurseries, orchards, paddocks, truck farming, viticulture and raising of furbearing animals and poultry.
FENCE: An artificially constructed structure on or above the ground surface which acts as or is designed or intended to act as a barrier and/or as a screen, and consists of any material or combination of materials, including, but not limited to, those structures erected to enclose, separate and/or screen areas of land. The term "fence" also includes, but is not limited to, solid freestanding structures such as screens and walls.
FILTERED VIEW: The maintenance or establishment of woody vegetation of sufficient density to screen developments from a stream or wetland, to provide for stream bank stabilization and erosion control, to serve as an aid to infiltration of surface runoff and to provide cover to shade the water. The vegetation need not be so dense as to completely block the view. Filtered view means no clear cutting.
FINISH ELEVATION: The proposed elevation of the land surface of a site after completion of all site preparation work.
FLAG: A sign printed on and/or made of fabric or other flexible material which is mounted and flown on a single pole.
FLASHING SIGN: Any illuminated sign and/or flashing light where each artificial light unit is not maintained in a stationary condition or where all light units are not constant in intensity and/or color at all times when such sign is illuminated. Illuminated signs which indicate the time and/or temperature shall not, for that reason alone, be considered flashing signs.
FLOOD: A general and temporary condition of partial or complete inundation of normally dry land areas from overflow of inland or tidal waves, the unusual and rapid accumulation or runoff of surface waters from any source.
FLOOD FREQUENCY: A period of years, based on a statistical analysis, during which a flood of a stated magnitude may be expected to be equalled or exceeded.
FLOOR AREA: The sum of the gross horizontal areas of the several floors of a building or structure measured from the exterior faces of the exterior walls. The floor area of a building or structure shall include: basement floor area, elevator shafts, stairwells, floor space used for mechanical equipment (except equipment open or enclosed located on the roof), penthouses, attic space having headroom of seven feet (7') or more, interior balconies and mezzanines, enclosed porches, floor area devoted to accessory uses, accessory storage areas located within selling or working space such as counter, racks or closets and space devoted to retailing activities, to the production or processing of goods or to business or professional offices. The term floor area shall not include any space devoted to off street parking or loading.
The floor area of structures devoted to bulk storage of materials, including, but not limited to, grain elevators and petroleum storage tanks shall be determined on the basis of height in feet, i.e., one foot (1') in height shall equal ten (10) square feet of floor area.
FLOOR AREA RATIO: The gross floor area of all buildings on a lot divided by the lot area.
FOREST: Areas or stands of trees the majority of which are greater than twelve inches (12") caliper measured four feet (4') above grade, covering an area greater than one-fourth (1/4) acre or groves of mature trees without regard to minimum area consisting of more than ten (10) individual specimens.
FREESTANDING SIGN: Any mobile or portable sign or sign structure not securely attached to the ground or to any other structure. This shall not include car signs as defined herein.
FREQUENCY: Signifies the number of oscillations per second in a sound wave and is an index of the pitch of the resulting sound.
FRONTAGE: The length of the front property line of the lot, lots or tract of land abutting a public street, road, highway or rural right of way.
FUNERAL HOME: A building used for the preparation of the deceased for burial and the display of the deceased and ceremonies connected with before burial or cremation.
GARAGE: A fully enclosed accessory building or structure, or part thereof, used or intended to be used for the parking and storage of private passenger vehicles.
GEOTHERMAL ENERGY SYSTEM:    A system which utilizes renewable energy generated from the interior of the Earth and used to produce energy for heating buildings or serving building commercial or industrial processes. A Geothermal Energy System does not include systems that use energy independent of the geothermal source to raise the temperature of the extracted heat, such as heat pumps.
GRADE: The degree of rise or descent of a sloping surface.
GRADE, EXISTING: The existing grade shall be the elevation of the ground surface as measured at a particular location on a lot or parcel prior to any work on or disturbance of the land comprising such lot or parcel, including the disturbance or removal of any existing trees thereon, and without regard to any regrading or other changes in the topography of said lot or parcel done within thirty six (36) months prior to any application being filed for any work to be performed on such lot or parcel.
GROUND OR POLE SIGN: Any sign which is supported by structures or supports in or upon the ground and independent of support from any building. This shall not include "billboard" signs as defined herein.
HABITABLE ROOM: Any room in a dwelling unit other than a bathroom, closet, pantry, hallway, storage space, garage and basement.
HEALTH AND FITNESS: See definition of Recreation, Indoor.
HEALTHCARE FACILITIES: Any hospital, general hospital, communicable disease hospital, school or home for the mentally disturbed or retarded, school or home for the physically handicapped, nursing home or shelter care home.
HEIGHT, BUILDING OR STRUCTURE: Height of a building or structure is the vertical distance from the sidewalk level or its equivalent established grade opposite the center of the front of a building or structure to the highest point of the coping in the case of a flat roof, to the deck line of a mansard roof and to the mean level of the underside of the rafters between the eaves and the ridge of a gable, hip or gambrel roof. Where no sidewalk level has been established, the height of a building or structure may be measured from the mean elevation of the finished lot grade at the front of the building or structure.
HOME OCCUPATION: Any activity carried out for gain by a resident conducted as an accessory use in the resident's dwelling unit. In general, a home occupation is an accessory use so located and conducted that the average neighbor, under normal circumstances, would not be aware of its existence.
HOSPITAL: An institution devoted primarily to the maintenance and operation of facilities for the diagnosis, treatment and overnight care of three (3) or more nonrelated individuals suffering from illness, disease, injury, deformity or other abnormal physical, mental or emotional conditions or afflictions.
ILLUMINATED SIGN: Any sign illuminated in any manner by an artificial light source.
IMPERMEABLE: Not permitting the passage of water.
IMPERVIOUS SURFACE: Any hard surfaced, manmade area that does not readily absorb or retain water, including, but not limited to, building roofs, parking and driveway areas, graveled areas, sidewalks and paved recreation areas.
IMPROVEMENT: Any humanmade, immovable item which becomes part of, placed upon or is affixed to real estate.
INDIVIDUAL SEWAGE DISPOSAL SYSTEM: A system for the disposal of sanitary sewage in the ground which is so designed and constructed as to treat sewage in a manner that will retain most of the settleable solids in a septic tank and discharge the liquid portion to an adequate disposal field.
INDUSTRIAL PARK: A large tract of land that has been planned, developed and operated as an integrated facility for a number of individual industrial uses with special attention to circulation, parking, utility needs, aesthetics and compatibility.
INTEGRAL SIGN: Memorial signs or tablets, names of buildings and date of erection when cut into any masonry surface or when constructed of bronze or other incombustible materials mounted on the face of a building.
KENNEL: The definition of "kennel" shall be as defined from time to time in section 4-3-1, "Definitions", of this Code.
LAKE OR POND: Any inland body of water fed by spring or surface water flow.
LARGE WIND ENERGY SYSTEM: A wind energy conversion system consisting of a wind turbine, a tower or mounting, and associated control or conversion electronics, which is intended primarily to generate utility power at a commercial scale.
LOT: A designated parcel, tract or area of land established by plat, subdivision or as otherwise permitted by law to be used, developed or built upon as a unit and having its principal frontage on a street.
LOT AREA: The horizontal area bounded by the front, side and rear lot lines measured within the lot boundaries, excluding public rights of way.
LOT, CORNER: A lot situated at the intersection of two (2) streets.
LOT COVERAGE: That portion of the land that is covered by buildings, structures and all other humanmade improvements on the ground surface which are more impervious than the natural surface, such as paving, driveways, etc.
LOT DEPTH: The mean horizontal distance measured from the front lot line to the rear lot line within the lot boundaries.
LOT, INTERIOR: A lot other than a corner lot.
LOT LINE: A line of record bounding a lot which divides one lot from another lot or from a public or private street or any other public space.
LOT, MINIMUM AREA OF: The smallest lot area established by this title on which a use or structure may be located in a particular district.
LOT WIDTH: The horizontal distance between the side lot lines of a lot, measured parallel to the front lot line at the required front setback line, unless otherwise specified in these zoning regulations or in this code.
MANUFACTURED HOME: A structure, transportable in one or more sections, which is built on a permanent chassis and is designated for use with or without a permanent foundation when connected to the required utilities. The term manufactured homes also includes park trailers, travel trailers and other similar vehicles placed on site for more than one hundred eighty (180) consecutive days. For the purposes of this title, a manufactured home shall not be considered a single-family detached dwelling.
MANUFACTURED HOME PARK OR SUBDIVISION: A parcel (or contiguous parcels) of land divided into two (2) or more manufactured home lots for rent or sale.
MARQUEE: Any hood or awning of permanent construction projecting from the wall of a building but not supported by the ground or sidewalk.
MASSAGE: The performance of manipulative exercises upon the human body of another by rubbing, kneading, stroking or tapping with the hand or hands, or with any mechanical or bathing device with or without supplementary aids.
MASSAGE PARLOR: Any place or establishment where a massage is made available.
MASSAGE SCHOOL: Any place or establishment or facility which provides instructions in the theory, method and practice of massage.
MEDICAL CANNABIS CULTIVATION CENTER: A "cultivation center" as defined in the compassionate use act.
MEDICAL CANNABIS DISPENSING ORGANIZATION: A "medical cannabis dispensing organization" as defined in the compassionate use act.
MICRON: A unit of length equal to one-thousandth (0.001) part of one millimeter (1 mm).
MINIMUM HABITABLE FLOOR AREA: The total floor area of all the habitable rooms in a dwelling unit.
MIXED USE DEVELOPMENT: The development of a tract of land or building or structure with two (2) or more different uses such as, but not limited to, residential, office, manufacturing, retail, public or entertainment in a compact form.
MONUMENT SIGN: A permanent ground sign.
MOVING SIGN: Any sign that has an external or visible part or parts that move, rotate or spin. Signs which indicate the time and/or temperature shall not for that reason alone be considered moving signs.
MUNICIPAL SIGN: Any sign located on public property and/or within any public right-of-way which has been approved by the public body owning or having maintenance jurisdiction over such location, including, but not limited to: traffic-control signs, traffic signals and devices; legal notices, identification signs for public buildings, or departments, divisions, services, or structures of a public body; any informational, directional, or warning sign; any warning sign or regulatory sign required by Federal or State law or local ordinance; railroad crossing signs; temporary emergency signs; and such other signs as may be approved by the Governing Body or executive authority of the public body owning or having maintenance jurisdiction over such location, which are determined by such public body to serve a public purpose.
NAMEPLATE: Any sign which states the name or address or both of the business or occupancy of the lot where the sign is placed.
NET METERING: An arrangement by which excess energy generated by a Renewable Energy System is distributed back to the electrical utility grid.
NONCONFORMING LOT: A lot, the area, dimensions or location of which was lawful prior to the adoption, revision or amendment of the ordinance codified in this title but which fails by reason of such adoption, revision or amendment to conform to the present requirements of the zoning district.
NONCONFORMING SIGN: Any sign which does not conform to the regulations of chapter 9 of this title.
NONCONFORMING STRUCTURE OR BUILDING: A structure or building the size, dimensions or location of which was lawful prior to the adoption, revision or amendment of the ordinance codified in this title, but which fails by reason of such adoption, revision or amendment to conform to the present requirements of the zoning district.
NONCONFORMING USE: A use or activity which was lawful prior to the adoption, revision or amendment to the ordinance codified in this title but which fails by reason of such adoption, revision or amendment to conform to the present requirements of the zoning district.
NORTH AMERICAN VERTICAL DATUM OF 1988 (NAVD88): The current vertical datum for orthometric heights established for vertical control surveying for the contiguous United States of America.
NUISANCE: An interference with the enjoyment and use of property.
NUISANCE ELEMENT: Any environmental pollutant, such as smoke, odors, liquid wastes, solid wastes, hazardous wastes, radiation, noise, vibration, glare or heat.
OBSTRUCTION: Any dam, wall, embankment, levee, dike, pile, abutment, soil material, bridge, conduit, culvert, building, wire, fence, refuse, fill, structure or other matter in, along, across or projecting into any channel, watercourse or flood plain which may impede, retard or change the direction of the flow of water, either in itself or by catching debris carried by such water or that is placed where the flow of water might carry the same downstream.
OCCUPANCY: The residing of an individual or individuals overnight in a dwelling unit or the installation, storage or use of equipment, merchandise or machinery in any public, commercial or industrial building.
OCTAVE BAND: A means of dividing the range of sound frequencies into octaves in order to classify sound according to pitch.
ODOR THRESHOLD: The minimum concentration of odorous matter in the air that can be detected as an odor.
OFF-SITE SIGN: See definition of "billboard".
OFF-STREET PARKING SPACE OR LOADING BERTH: An open, hard- surfaced area of land, other than a right-of-way, an access, a driveway or an aisle and the principal use of which is for the standing, loading and unloading of motor vehicles.
OFFICE BUILDING: A building used primarily for conducting the affairs of a business, profession, service, industry or government, or like activity, that may include ancillary services for office workers such as a restaurant, coffee shop, newspaper or candy stand.
OPACITY: The quality or state of an object that renders it impervious to the rays of light, the degree of nontransparency.
OPEN SPACE: Any parcel or area of land or water essentially unimproved and set aside, dedicated, designated or reserved for public or private use or enjoyment or for the use and enjoyment of owners and occupants of land adjoining or neighboring such open space.
OPEN SPACE, COMMON: Land within or related to a development, neither individually owned nor dedicated for public use, which is designed and intended for the common use or enjoyment of the residents of the development and may include such complementary structures and improvements as are necessary and appropriate.
OWNER: Any person, group of persons, firm or firms, corporation or corporations or any other legal entity holding title of land covered by this title.
PARKING LOT ACCESSORY: An open, hard surfaced area other than a right-of-way which is accessory to the principal use of the lot and which is intended and used for the storage of private motor vehicles owned by members of the family or families residing upon the premises or by the owners, employees or patrons of the business or industrial uses.
PARTICULATE MATTER: Material which is suspended in or discharged into the atmosphere in finely divided form as a liquid or solid such as dust.
PERFORMANCE STANDARDS: Criteria established to control noise, odor, glare, exterior lighting, vibration, smoke, particulate matter, gases, fire and explosion hazards and wastes generated by or inherent in uses of buildings, structures or land.
PERMANENT SIGN: Any sign other than a temporary sign.
PERMITTED USE: Any use allowed in a zoning district and subject to the restrictions applicable to that zoning district.
PERSON: Any person, firm, partnership, trust, corporation, association or organization, singular or plural, of any kind.
PLAN COMMISSION: The Plan Commission of the Village of Lake Barrington, Illinois.
PLANNED UNIT DEVELOPMENT: The development of a parcel of land having a previously approved overall plan according to the rules and regulations stipulated in the Planned Unit Development Regulations of the Village of Lake Barrington, as adopted or amended 1 .
POINT-OF-SALE SIGN: Any sign which carries only the name of the firm, major enterprise or products offered for sale on the premises, or a combination of these things.
POLE BUILDINGS: Any building construction which includes the use of the same poles buried in the ground to both provide foundation for the building as well as to provide the exterior frame of the building.
PORTABLE SIGN: Any sign designed to be moved from place to place.
PORTABLE STORAGE UNIT: Any container, whether or not consisting of a trailer, semitrailer, or any other container, whether or not equipped with wheels or rollers, which is designed, intended for use for storage, and/or used for storage.
PROJECTING SIGN: Any sign other than a wall sign affixed to any building or wall whose leading edge extends beyond such building or wall.
PUBLIC DOMAIN: All lands owned by government.
PUBLIC UTILITY: A closely regulated private enterprise with an exclusive franchise for providing a public service.
PUBLICLY NAVIGABLE WATERS: All streams and lakes capable of being navigated by watercraft.
PYLON SIGN: Any advertising sign or structure so designed and constructed that it forms an integral part of the building and is not merely affixed or attached.
RATABLE PROPERTY: Real property subject to tax by a municipality or other taxing district.
REAL ESTATE SIGN: Any sign which is used to offer for sale, lease or rent the property upon which the sign is placed.
RECREATION FACILITY: A place designed and equipped for the conduct of sports, leisure time activities and other customary and usual recreational activities.
RECREATION, INDOOR: Public or private recreation facilities, health and fitness facilities, tennis or other racquet courts, indoor golf driving ranges, indoor baseball facilities, swimming pools, bowling alleys, bocce ball, skating rinks, billiard halls, or similar uses which are enclosed in buildings and which may or may not be operated on a membership basis. "Recreation, indoor" shall include any accessory uses, such as snack bars, pro shops, tanning and sauna facilities, and locker rooms, which are designed and intended primarily for the use of patrons of the principal recreational use, but shall not include theaters, cultural facilities, commercial amusement centers, or massage parlors.
REGISTERED LAND SURVEYOR: A land surveyor registered in the State of Illinois, under the Illinois Professional Land Surveyor Act of 1989 2 .
REGISTERED PROFESSIONAL ENGINEER (PE): An engineer registered in the State of Illinois, under the Professional Engineering Practice Act of 1989 2 .
RENEWABLE ENERGY SYSTEM: A system that generates energy from natural resources such as sunlight, wind, and geothermal heat. As used herein, the term "Renewable Energy System" refers to Large Wind Energy Systems, Small Wind Energy Systems, Geothermal Energy Systems, and Solar Energy Systems only.
REPAIR, REMODELING OR MAINTENANCE: Construction activities which do not result in any increases in the outside dimensions of a building or any changes to the dimensions of a structure.
RESIDENTIAL DENSITY: The number of dwelling units per acre of residential land.
RESTAURANT: Restaurant, coffee shop, cafeteria, short order cafe, luncheonette, tavern, bar, cocktail lounge, sandwich stand, drive-in or drive-through restaurant, fast food restaurant, outdoor cafe, soda fountain and any other eating and/or drinking establishment, organization, club, whether public or private, or a temporary or movable structure or vehicle, from which is given, sold or offered for sale, food to the public, guests, employees or patrons, as well as kitchens or other places in which food or drink is prepared for sale elsewhere or kitchens or other places in which, for a fee, food or drink is prepared for consumption off the premises including catering functions.
RESTRICTION: A limitation on property which may be created in a property deed, lease or mortgage through certain zoning or subdivision regulations or as a condition of approval of an application for development.
RETENTION/DETENTION FACILITY: A retention facility stores stormwater runoff without a gravity release. A detention facility provides for storage of stormwater runoff and controlled release of this runoff during and after a flood or storm.
REZONE: To change the zoning classification of particular lots or parcels of land.
RIGHT OF WAY: A strip of land acquired by reservation, dedication, prescription or condemnation and intended to be occupied or occupied by a road, crosswalk, railroad, transmission lines, oil or gas pipeline, water line, sanitary storm sewer, trail, bicycle path and other similar uses.
RIGHT-OF-WAY LINES: The lines that form the boundary of a right of way.
RINGELMANN CHART: A chart which is described in the U.S. Bureau of Mines Information Circular 8333 and on which are illustrated graduated shades of gray for use in estimating the light-obscuring capacity of smoke and smoke density.
RINGELMANN NUMBER: The number of the area on the Ringelmann Chart that coincides most nearly with the visual density of emission or the light obscuring capacity of the smoke.
ROOF SIGN: Any sign erected or constructed wholly upon and over the roof of any building and supported solely on the roof structure.
SATELLITE ANTENNA, PRIVATE: Any accessory structure capable of receiving, for the sole benefit of the principal land use, radio, television or data microwave signals from a transmitter or a transmitter relay located in earth orbit. This definition includes, but is not limited to, satellite receivers, satellite dish antennas, satellite discs, direct broadcast systems and television reception only systems.
SCHOOL: Any building or part thereof which is designed, constructed or used for educational or instruction in any branch of knowledge.
SETBACK: The required minimum horizontal distance between a lot line and a building, structure, parking area, driveway or accessory building.
SHELTERED CARE: Maintenance and personal care, exclusive of nursing, for persons incapable of maintaining a private independent residence.
SHELTERED CARE HOME: A private boarding home, institution, building, residence or other place, which, through its ownership or management provides sheltered care to three (3) or more adults who are not related to the applicant or owner by blood or marriage.
SMALL WIND ENERGY SYSTEM: A wind energy conversion system consisting of a wind turbine, a tower or mounting, and associated control or conversion electronics, which is intended primarily to reduce on-site consumption of utility power. All small wind energy systems, whether ground-mounted or building-mounted, are prohibited in all of the Village's zoning districts, except within the B, O, and M Zoning Districts where each shall require specific authorization by a special use permit approved by Village ordinance.
SMALL WIND ENERGY SYSTEM, BUILDING-MOUNTED : A Small Wind Energy System affixed to a building or other principal structure.
SMALL WIND ENERGY SYSTEM, GROUND-MOUNTED: A Small Wind Energy System that is not attached to another structure and is affixed to the ground, or that is attached to an antenna, light pole or other utility facility.
SMOKE: The visible discharge from a chimney, stack, vent, exhaust or combustion process which consists of particulate matter.
SMOKE UNIT: The number obtained when the smoke density in Ringelmann number is multiplied by the time of emission in minutes. For the purpose of this calculation, a Ringelmann density reading shall be made at least once a minute during the period of observation. Each reading is then multiplied by the time in minutes during which it was observed. The various products are then added together to give the total number of smoke units observed during the entire observation period.
SOLID WASTE: Unwanted or discarded material including garbage with insufficient liquid content to be free flowing.
SOLID WASTE DISPOSAL: The ultimate disposition of solid waste that cannot be salvaged or recycled.
SPECIAL DISTRICT: A district created by act, petition or vote of the residents for a specific purpose with the power to levy taxes.
SPECIAL FARM USE: Commercial game animals farm, including, but not limited to, mink or other furbearing animal ranches, commercial mushroom production barn and commercial piggery.
SPECIFIED ANATOMICAL AREA: Less than completely and opaquely covered: human genitals, pubic region; buttock; female breast below a point immediately above the top of the areola; and human male genitals in a discernible turgid state even if completely and opaquely covered.
SPECIFIED SEXUAL ACTIVITIES: Human genitals in a state of sexual stimulation or arousal; acts of human masturbation, sexual intercourse or sodomy; fondling or other erotic touching of human genitals, pubic regions, buttock or female breast.
STABLE, COMMERCIAL: A building or land where equine are kept for remuneration, hire, sale, boarding, riding or show.
STABLE, PRIVATE: Any building incidental to an existing principal use which provides shelter for equine for the exclusive use of the occupants of the premises.
STREET: Any vehicular way which:
   A.   Is an existing State, County or Municipal roadway; or
   B.   Is shown upon a plat approved pursuant to law; or
   C.   Is approved by other official action and includes the land between the street lines, whether improved or unimproved.
STRUCTURE: Anything that is the result of a humanmade change constructed, erected or moved to or from any premises which is located above, on, or below the ground including, but not limited to, construction, reconstruction or placement of a building or any addition to a building; installing a manufactured home on a site, preparing a site for a manufactured home or installing a travel trailer on a site for more than one hundred eighty (180) days; installing utilities, construction of roads or similar projects; construction or erection of levees, walls, fences, bridges or culverts; drilling, mining, filling, dredging, grading, excavating; and the storage of materials. Temporary recreational facilities including, but not limited to, tents, camper trailers and recreation vehicles are not considered structures when used less than one hundred eighty (180) days per year and located landward of the minimum setback provided as a natural vegetation strip.
SUBSTANTIAL DAMAGE: Damage of any origin sustained by a structure whereby the cost of restoring the structure to its before damaged condition would equal or exceed fifty percent (50%) of the market value of the structure before the damage occurred.
SURFACE AREA: In the case of a double-faced sign, only one side of the sign is considered in determining sign area if: a) the sign is substantially identical on both sides, and b) the sides of the sign diverge at an angle of less than forty five degrees (45°). If the sign is composed of individual letters, words, symbols or elements, using a wall, awning, canopy, window, or other landscape or architectural feature as the background with no added decoration, the total sign area shall be calculated by measuring the area of an imaginary rectangle that encloses the extreme limits of the individual letters, words, symbols or elements.
TAVERN, COCKTAIL LOUNGE: An establishment in which the principal business is the sale of alcoholic beverages to patrons for consumption on the premises. A liquor license from the Liquor Commissioner of the Village is required.
TAX EXEMPT PROPERTY: Property which because of its ownership or use is not subject to property taxation and meets State requirements for tax exempt status.
TEMPORARY SIGNS: Any sign that, by reason of the material(s) with which it is constructed and/or its manner of construction, is intended to remain only for a short duration generally not to exceed ninety (90) days, except as otherwise expressly provided in this chapter.
TEMPORARY STRUCTURE: A structure without any foundation or footings and which is removed when the designated time period, activity or use for which the temporary structure was erected has ceased.
TEMPORARY USE: A use established for a fixed period of time with the intent to discontinue such use upon the expiration of the time period.
TOTAL SYSTEM HEIGHT: The total height of the tower and the wind turbine of a Small Wind Energy System, as measured from the average grade at the base of the system to the top of the blade or rotor.
USE: The purpose or activity for which land or buildings are designed, arranged or intended or for which land or buildings are occupied or maintained.
UTILITY SERVICES: Establishments engaged in the generation, transmission and/or distribution of electricity, cable television, telephone, gas or steam, including water and irrigation systems and sanitary systems used for the collection and disposal of garbage, sewage and other wastes by means of destroying or processing materials.
VARIATION: Permission to depart from the literal requirements of a zoning ordinance.
VARIATION, BULK: A departure from any provision of a zoning ordinance except use.
VARIATION, USE: A variation granted for a use or structure that is not permitted in the zone.
VEGETATION: All plant growth, especially trees, shrubs, mosses and grasses.
VEHICLE DEALER: Any establishment engaged in the sale and/or long term leasing and/or short term rental of vehicles and/or trailers, and/or accessories for same and including, but not limited to, the sale or leasing of automobiles, motorcycles, all-terrain vehicles, trucks, trailers, snowmobiles, boats, and/or personal watercraft.
VEHICLE REPAIR SERVICE AND GARAGE: Any establishment engaged in furnishing repair of vehicles, including, but not limited to, mechanical repairs, body repairs, upholstery replacement and/or repairs, and/or parking services.
VEHICLE SERVICE STATION: Any building, land area or other premises or portion thereof used or intended to be used for the retail dispensing or sales of fuels for motor vehicles and/or the sale and installation of lubricants, tires, batteries, or other accessories or equipment related to vehicles, including, but not limited to, mufflers, brakes, truck beds, truck tops, hitches and plows.
VEHICLE SIGN: A sign attached to, painted on, or otherwise applied to an operable or inoperable motor vehicle, van, or trailer which is parked or placed in position where it is intended to function as a permanent or temporary sign.
VEHICLE WASH: Any building or premises or portions thereof used for washing, waxing, and/or detailing of motor vehicles.
VETERINARY HOSPITAL: A building structure or portion thereof designed or used for the care, observation or treatment of domestic animals.
VIBRATION: A periodic motion of the particles of an elastic body or medium in alternately opposite directions from the position of equilibrium when that equilibrium has been disturbed.
VIOLATION: The act of disregarding, disobeying, neglecting, omitting or refusing to comply with the regulations or enforcement of this title.
WALL SIGN: Any sign painted on or attached to and erected parallel to the face of, or erected and confined within the limits of the outside wall of any building and supported by such wall or building and which displays only one advertising surface.
WINDOW SIGN: Any sign placed inside or upon a window or door facing the outside and which is intended to be seen from the exterior.
YARD: An open space that lies between the principal or accessory building or buildings and the nearest lot line. Such yard is unoccupied and unobstructed from the ground upward except as may be specifically provided in this title.
YARD DEPTH: The shortest distance between a lot line and a yard line.
YARD, FRONT: A space extending the full width of the lot between any building and the front lot line and measured perpendicular to the building at the closest point to the front lot line. Such front yard shall be unoccupied and unobstructed from and including the ground upward except as may be permitted elsewhere in this title. In any residential zoning district, the only use(s), occupation(s), obstruction(s), or structure(s) permitted within front yards are: a) walkways; b) uncovered steps; c) landscaping, including, but not limited to, retaining walls not in excess of three feet (3') in height; d) drainage improvements and drainage structures; and e) vehicles parked within the confines of a driveway on an improved surface (i.e., a surface of asphalt, concrete, pavement, brick or gravel). Any use(s), occupation(s), obstruction(s), or structure(s) not specifically permitted by these zoning regulations shall be and is hereby excluded and prohibited from any required front yard. No use(s), occupation(s), or obstruction(s) of any front yard in violation of this definition, not involving a building or structure, shall be permitted to continue or to remain after January 1, 2001.
YARD LINE: A line drawn parallel to a lot line at a distance therefrom equal to the depth of the required yard.
YARD, REAR: A space extending across the full width of the lot between the principal building and the rear lot line and measured perpendicular to the building to the closest point of the rear lot line. Such rear yard shall be unoccupied and unobstructed from and including the ground upward except as may be permitted elsewhere in this title. In any residential zoning district, the only permitted use(s), occupation(s), obstruction(s), or structure(s) within rear yards are: a) walkways; b) uncovered steps; c) fences and berms, but only as permitted by and in compliance with section 8-3-8 of this title; d) landscaping, including, but not limited to, retaining walls not in excess of three feet (3') in height; and e) drainage improvements and drainage structures. Any use(s), occupation(s), obstruction(s), or structure(s) not specifically permitted by these zoning regulations shall be and is hereby excluded and prohibited from any required rear yard in any residential zoning district. No use(s), occupation(s), or obstruction(s) of any rear yard in violation of this definition, not involving a building or structure, shall be permitted to continue or to remain after January 1, 2001.
YARD, REQUIRED: The open space between a lot line and the buildable area within which no structure shall be located except as provided in this title.
YARD, SIDE: A space extending from the front yard to the rear yard between the principal building and the side lot line measured perpendicular to the closest point of the principal building. Such side yard shall be unoccupied and unobstructed from and including the ground upward except as may be permitted elsewhere in this title. In any residential zoning district, the only permitted use(s), occupation(s), obstruction(s), or structure(s) within side yards are: a) walkways; b) uncovered steps; c) fences and berms, but only as permitted by and in compliance with section 8-3-8 of this title; d) landscaping, including, but not limited to, retaining walls not in excess of three feet (3') in height; and e) drainage improvements and drainage structures. Any use(s), occupation(s), obstruction(s), or structure(s) not specifically permitted by these zoning regulations shall be and is hereby excluded and prohibited from any required side yard. No use(s), occupation(s), or obstruction(s) of any side yard in violation of this definition, not involving a building or structure, shall be permitted to continue or to remain after January 1, 2001.
ZONING BOARD OF APPEALS: The Zoning Board of Appeals of the Village of Lake Barrington, Illinois.
ZONING DISTRICT MAP: The map incorporated herein by reference which designates zoning districts.
ZONING PERMIT: A document signed by the Enforcement Officer as required in this title, as a condition precedent to the commencement of a use or the erection, construction, reconstruction, restoration, alteration, conversion or installation of a structure or building, which acknowledges that such use, structure or building complies with the provisions of the Municipal zoning or authorized variation therefrom.
