A. Regulations Adopted: Adopted: That certain printed document entitled the International Swimming Pool and Spa Code, 2018 Edition (sometimes referred to in this Title as the "ISPSC"), as published by the International Code Council, 4051 West Flossmoor Road, Country Club Hills, IL 60477, a copy of which Code was on file in the office of the Village Clerk for inspection and/or copying by the public for at least thirty (30) days prior to adoption thereof, be and is hereby adopted by reference and made a part of this title as additional rules and the minimum requirements for the design, construction, alteration, repair and maintenance of swimming pools, spas, hot tubs and aquatic facilities in the Village; and it shall be unlawful for any person to fabricate, erect, construct, enlarge, alter or repair or cause to be fabricated, erected, constructed, enlarged, altered or repaired any such swimming pool or spa, in the village in violation of or without complying with those rules and regulations. In the event of any conflict between said swimming pool and spa code hereby adopted and any other regulation or other code adopted in this title or elsewhere in this Code, the more restrictive provisions shall govern.
Chapter 2, Definitions, of the ISPSC is hereby amended by adding the following definitions in alphabetical order:
Definitions:
As used in this chapter, the following words and terms shall have the meanings ascribed to them in this section:
Pool Area: An outdoor swimming pool (excluding appurtenant equipment) and the area surrounding it constructed and designed as a lounging area for use in conjunction with the pool.
Spa: An outdoor hydromassage pool or tub for recreational or therapeutic use, designed for immersion of users and usually having a filter, heater, and motor driven blower. It may be installed on the ground or on a supporting structure, or in the ground. A spa is intended for recreational bathing and is capable of containing water over twenty four inches (24") deep and has a span less than nine feet (9') at all points. Also referred to as a "hot tub".
Swimming Pool: An outdoor receptacle for water or an artificial pool of water intended for the purpose of immersion or partial immersion therein of human beings having a depth at any point of two feet (2') or more, whether or not placed in an excavation. No swimming pool shall extend more than two feet six inches (2'6") above the pre-existing ground level or more than two feet six inches (2'6") above the average existing ground level around the perimeter of the subject swimming pool, whichever elevation is lower. This restriction is intended to hereafter prohibit the construction and/or installation of any above-ground swimming pool(s) on any zoning lot or parcel located within the Village. A swimming pool includes all appurtenant equipment such as, but not limited to, pumps, filters and disinfectant equipment. Any above-ground swimming pool(s) which currently exists within the Village as of the effective date of this Ordinance but which is in excess of two feet six inches (2'6") above the pre-existing ground level or which is more than two feet six inches (2'6") above the average existing ground level around the perimeter of the subject swimming pool may remain on the property of the owner(s) thereof, but only if such swimming pool was originally installed pursuant to a duly-issued Village permit, and then only until such swimming pool is in need of any substantial repair or replacement, at which time such swimming pool shall be promptly removed from the site and shall not thereafter be replaced."
Chapter 3 of the ISPSC is hereby amended by adding the following:
Compliance Required:
It shall be unlawful to construct, maintain, install or enlarge any swimming pool in the village except in compliance with all the provisions of this appendix. Notwithstanding any other provisions of this appendix, the following regulations shall apply to all swimming pools constructed or maintained in the village; provided, however, to the extent such regulations are inconsistent with the other provisions of this appendix, the more restrictive requirements shall govern.
Location:
No portion of any swimming pool shall be located within twenty-five feet (25') from any septic tank or any septic field.
Permit Required; Fees:
Prior to the construction, installation, enlargement or alteration of any swimming pool or appurtenances, a permit shall be obtained from the building commissioner. Drawings and plans shall first be presented to the building commissioner for examination and approval and each pool shall be constructed in conformity with the approved plans. The fee for such a swimming pool permit shall be as established and as specified from time to time in section 1-10-7 of the village code.
Inspection:
The building commissioner may periodically inspect all swimming pools to determine whether or not the provisions of this Code regarding health, sanitation and safety applicable hereto are being complied with.
Construction Specifications, Pool Requirements:
A. Recirculation Pools: All swimming pools having a water surface area of two hundred fifty (250) square feet or more shall be of the recirculation type in which circulation of the water is maintained through the pool by pumps and the water drawn from the pool is clarified before being returned to the pool.
B. Walk Area: The pool area shall include an unobstructed walk area not less than four feet (4') wide immediately next to the swimming pool (excluding appurtenant equipment) and extending entirely around said swimming pool.
C. Steps Or Ladders: At least two (2) or more means of egress in the form of steps or ladders shall be provided for all swimming pools, one of which shall be located at the deep end of the pool and one of which shall be located at the shallow end of the pool. Treads of steps shall be at least six inches (6") inside for their full length and ladders shall be constructed of nonslip material and at least three inches (3") wide for their full length. Ladders shall have a handrail on both sides. In the case of an aboveground pool where the means of access is a ladder or steps, then the ladder or steps shall be capable of being secured, locked or removed to prevent access.
D. Drainage Of Pools:
1. Water drained from the pools shall not be discharged during periods of rain or storms and shall not be discharged so as to drain across or onto adjacent property or across or onto a road in such a manner as to cause damage to any part of the road, including any swale or other drainage structure.
2. No pool shall be drained into any septic system or septic field or be drained in such manner as to cause such septic system or septic field to malfunction or to contribute to the malfunction of any such septic system or septic field.
3. All water shall be drained entirely upon the property on which the swimming pool is located and shall not flow on any adjoining property. (Ord. 2011-O-07, 4-6-2011)
E. Electrical Requirements:
1. Compliance Required: All electrical installations provided for, installed and used in conjunction with private residential swimming pools shall be in conformance with the provisions of this code regulating electrical installations.
2. Electrical Conductors: No current-carrying electrical conductors shall cross private residential swimming pools, either overhead or underground or within fifteen feet (15') of such pools.
3. Ground: All metal fences, enclosures or railings near or adjacent to swimming pools which might become electrically alive as a result of contact with broken overhead conductors or from any other cause shall be effectively grounded.
4. Underwater Light Fixtures: Underwater lighting fixtures shall be approved for the service.
5. Electrical Receptacles: Receptacles shall not be used within fifteen feet (15') of the pool.
F. Safety Precautions:
Every swimming pool shall be equipped with one or more throwing ring buoys not more than fifteen inches (15") in diameter.
G. Nuisance:
Pools shall be operated with due consideration to the comfort and well being of adjoining property owners. Lighting shall be directed so as not to constitute a nuisance or annoyance to other property owners.
