7-2-14: PERMITS AND RELATED FEES APPLICABLE TO THE LAKE BARRINGTON SHORES PLANNED DEVELOPMENT:
There are hereby established certain permits and related fees which shall be applicable only to properties and common elements located within the Lake Barrington Shores Planned Development (hereinafter sometimes referred to as "LBS" or as the "LBS Development"), including but not limited to the following:
   A.   Blanket Building Permit(s):
      1.   A Blanket Building Permit (sometimes referred to herein as a "Blanket Permit") is an annual building permit that the Village may issue only to the Lake Barrington Community Homeowners' Association ("LBCHA") for a specific project which encompasses the same work to be performed on the exterior of one or more condominium buildings and/or the adjacent property and/or on common areas within the LBS Development during the same permit period, which permit shall be issued on an annual basis and shall be valid for a period from May 1 through April 30 of the following year unless otherwise noted on the Permit. Issuance of a Blanket Building Permit requires submittal by the LBCHA of and payment to the Village of the following:   
         a.   A completed application for a Blanket Permit, together with the payment of the related application fee(s), and reimbursement to the Village for any related costs incurred by the Village relative to the subject project, including but not limited to engineering fee(s), inspection fee(s), and/or plan review fee(s), which fee(s) and cost(s) are as specified from time to time in Section 1-10-7 of this Village Code;
         b.   A copy of the contractor's proposal, or in lieu of the contractor's proposal, a reasonable amount of project detail shall be provided about the subject project to the Village as determined by the Village Administrator;
         c.   A copy of the plans and drawings for the subject project; and
         d.   By April 30 of each year, the LBCHA shall provide to the Village's Building Department a list containing the addresses or areas where work was completed for each such annual Blanket Permit issued.
      2.   Work which requires the issuance of a Blanket Building Permit shall include but not be limited to the following:
         a.   Concrete Sidewalks: The Village will review all plans for repair and/or replacement of concrete sidewalks and conduct inspection(s) of the work, if applicable. For replace   ment of concrete sidewalks, the Village's Building Inspector(s) must inspect and approve the risers in the field for any steps.
      b.   Driveways and Private Roads Within the LBS Development: A Blanket Permit shall be required for resurfacing, repair and/or replacement of driveway(s) and/or private road(s) within the LBS Development, and any such Blanket Permit(s) shall be issued only to the LBCHA. Blanket Permits for driveway resurfacing, repair and/or replacement shall cover all of those driveways which are resurfaced, repaired and/or replaced during the specific term of the respective Blanket Permit issued for a particular 12-month period, unless otherwise noted on the Permit. The Village's Building Inspector(s) shall review each application for a Blanket Permit submitted by the LBCHA for repair and/or replacement of driveways. However, if the LBCHA is resurfacing, removing and replacing a private road or adding a new private road, the LBCHA shall submit to the Village for the prior review and written approval by the Village Engineers all plans therefor prior to commencement of any work by the LBCHA and/or its contractor(s) regardless of the scope of work. The LBCHA shall also be required to reimburse the Village for any plan review costs and/or any engineering costs incurred by the Village for such project.
         c.   Fence Repair and/or Replacement: The LBCHA, as the applicant for the required annual Blanket Permit for such work, shall also be required to reimburse the Village for all necessary plan review costs incurred by the Village related to the Blanket Permit. One annual Blanket Permit for fence repair and/or replacement will be issued to the LBCHA for each Village fiscal year. Submittal to the Village of the contractor proposal(s) for fence repair and/or replacement work shall not be required as such work is performed on an "as needed" basis. Drawings shall be submitted to the Village where determined by the Village to be necessary based upon the complexity of the fence project or other special circumstances.
         d.   Tree Removal and/or Replacement: No changes are being made to the process which is now provided in Section 11-1-4(C)(8) of the Lake Barrington Village Code.
         e.   Retaining Walls:
            (1)   Any work proposed to be performed on a retaining wall forty-eight inches (48") in height or greater shall require application by the LBCHA for and issuance of an annual Blanket Permit. No permit is required for work on a retaining wall which is less than forty-eight inches (48") in height. Annual Blanket Permits for retaining walls shall be handled in the same manner as a fence permit unless the LBCHA requests the Village's Building Inspector(s) or Village Engineer to review and approve a specific retaining wall project, in which case the same process as a Building Structural Repair Permit will be utilized and, in such cases, the LBCHA shall apply for a separate, additional project-based Building/Structural Repair Permit and submission by LBCHA or its contractor to the Village of the related contractor proposal and plans for Village review and approval prior to commencement of any work. The application for such a project-based permit or for an annual Blanket Permit shall require payment of an application fee as specified from time to time in Section 1-10-7 of this Code. The LBCHA, as the applicant for such permit, shall also be required to reimburse the Village for all required plan review costs incurred by the Village and for any inspection(s).
            (2)   Any retaining wall proposed to be installed or repaired by a unit owner or the contractor for the unit owner shall require application to the Village for approval of a project permit for the project, together with payment of any required fee(s) for such permit, prior to commencement of any work on such project as provided by the other applicable provisions of this Village Code.
         f.   Storm Sewers:
            (1)   The addition or relocation of new storm sewer(s) shall require the issuance by the Village of an annual Blanket Permit, which permit will be issued to the LBCHA.
            (2)   Each repair or reconstruction of any existing storm sewer shall require the issuance by the Village of a Blanket Permit.
            (3)   The LBCHA, as the applicant for each such permit, shall also be required to reimburse the Village for any engineering fees and any plan review costs incurred by the Village for such project(s).
      3.   The Village of Lake Barrington shall not be obligated to conduct any inspection(s) of the work performed within the LBS Planned Development pursuant to a Blanket Building Permit issued to the LBCHA.
      4.   The LBCHA is obligated to, and it shall be the sole responsibility of the LBCHA to ensure that the project for which a Blanket Building Permit is issued has been completed according to the plans approved by the Village and in compliance with any inspection(s) by the Village's Building Department. No work shall be commenced by the LBCHA and/or by its contractor(s) prior to the LBCHA receiving the prior written approval of the Village.
   B.   Project Permit:
      1.   A Project Permit may be issued to either the LBCHA, to a specific Condominium Association, or to a specific condominium owner(s) within the LBS Development, as the case may be, for work related to a specific condominium unit, to a specific condominium building, and/or to a certain common element as specified herein, within the LBS Development. A Project Permit shall be valid for a period of six (6) months.
      2.   Prior to the issuance of any Project Permit or commencement of any work on a project, the applicant must submit the following to the Village:
         a.   A completed application for such permit, together with payment of the related application fee(s) as specified from time to time in Section 1-10-7 of this Code;
         b.   A copy of the contractor's proposal, or in lieu of the contractor's proposal, a reasonable amount of project detail shall be provided to the Village as determined by the Village Administrator; and
         c.   Project-specific plans for the subject project for the prior review and written approval of the Village's Building Inspector, or the Village Engineer, as the case may be.
         Standard inspections for each Project Permit shall also be required. The permit applicant is also required to reimburse the Village for any related costs incurred by the Village relative to the subject Project Permit, including but not limited to engineering fee(s), plan review fee(s), and/or inspection fee(s), which fee(s) and cost(s) shall be as specified from time to time in Section 1-10-7 of this Village Code.
      3.   Work which requires the issuance of a Project Permit includes but is not limited to the following:
         a.   Roof Replacement: A Project Permit for a roof replacement shall be applied for by and issued to either the respective Condominium Association for a particular condominium building or to the contractor of such Condominium Association. One permit will be issued for each entire building. Such a Project Permit will include two (2) inspections. Any additional inspection(s) in excess of two shall be the responsibility of the applicant to pay, the cost of which inspection(s) is as specified from time to time in Section 1-10-7 of this Code.
         b.   Window and Door Replacements: Permits for window and/or door replacement shall be applied for by and issued to the individual condominium owner(s) or to their contractor. Window and/or door replacement have the potential to cause structural damage to buildings and, therefore, additional inspections may be required in order to confirm that the installation, including but not limited to the installation of flashing, is done properly. The Village's building inspector(s) shall perform and complete inspections of each project in order to confirm compliance with the Village's Building Codes. Window replacement shall require nail fins on all four (4) sides of each window, and each new window shall be properly sealed.
         c.   Building Structural Repairs: All such work shall require the issuance of a Structural Repair project-based permit, and such a Structural Repair Permit shall be applied for by and issued to only the respective Condominium Association and not to individual condominium unit owner(s). Construction of an outside storage closet shall be considered such a "building structural repair". An application fee shall accompany the permit application and the respective Condominium Association shall also be required to reimburse the Village for the required plan review costs incurred by the Village and any inspections required for the project, which fees and costs are as specified from time to time in Section 1-10-7 of this Village Code. Excluded from such permits are any interior work in any individual unit as well as repair and/or replacement of windows and doors performed by the unit owner or the contractor of the unit owner on an individual unit, which work is addressed by other permit provisions of this Village Code.
         d.   Fireplaces: The repair and/or replacement of a chimney chase and/or chimney chase cover are the responsibility of each unit's condominium association. Structural repair of any component of a chimney below the chimney chase cover shall be the responsibility of the individual condominium owner(s), and for such work, a permit for a Residential Miscellaneous Project shall be required. A permit shall not be required for any work on a chimney chase or chimney chase cover from the roof line up. However, a Structural Repair Permit shall be required for any work below the roof line. The required Structural Repair Permit must be applied for by and shall be issued only to the respective condominium owner or their contractor(s). A separate permit shall be required for each such project, and the required application fee shall accompany the completed permit application. The applicant shall also be required to reimburse the Village for the required plan review costs incurred by the Village, and for any inspections. The fees and costs for such Structural Repair Permits shall be as specified from time to time in Section 1-10-7 of this Code.
         e.   Lake and Shoreline: The LBCHA is responsible for any work on and/or related to the body of water known as Lake Barrington and/or to its shoreline. A Project Permit for such work shall be issued only to the LBCHA or to its contractor(s). In some cases, a Watershed Development Permit issued by the Village or by the Lake County Stormwater Management Commission as required by Chapter 1, "Watershed Development", of Title 10, "Flood Control", of the Lake Barrington Village Code shall also be required. Prior to commencement of any work thereon, the LBCHA is required to submit a completed application to the Village for a Project Permit for any such work, together with payment of the respective application fee as specified from time to time in Section 1-10-7 of this Code, as well as a copy of the specific plans for each such project for the prior review and written approval by the Village Engineer. The LBCHA shall be required to reimburse the Village for any fee(s) for plan review, engineering, inspection(s), and for any other costs incurred by the Village with respect to such project.
         f.   Sanitary Sewers (Unit to Lateral Line Only, Not for a Main): The LBCHA shall be responsible for any work on and/or related to sanitary sewers located within and/or serving the LBS Planned Development. New, relocated, repaired, and/or reconstructed sanitary sewers shall require a specific Project Permit. The permit for such project shall be treated as a Quick Release Permit, whenever practical to do so. A Project Permit for such work shall be issued only to the LBCHA or to its contractor(s). Prior to commencement of any work thereon, the LBCHA is required to submit a completed application to the Village for a Project Permit for any such work, together with payment of the respective application fee as specified from time to time in Section 1-10-7 of this Code, as well as a copy of the contractor's proposal and specific plans for each such project for the prior review and written approval by the Village's Building Inspector(s). The LBCHA shall be required to reimburse the Village for any fee(s) for plan review, engineering, inspection(s), and for any other costs incurred by the Village with respect to a specific project. The LBCHA is also required to reimburse the Village for any related plan review, engineering and/or inspection fee(s) which are as specified from time to time in Section 1-10-7 of this Code.
