2-2-3: LICENSE REQUIRED ANNUALLY FOR ALL BUSINESSES AND OCCUPATIONS, OTHER THAN HOME OCCUPATIONS; DISCLOSURE OF TENANTS:
   A.   License Required Annually: Any person maintaining, operating, or conducting any business, occupation or establishment, or doing business or engaging in any activity or occupation or related activity generating any revenue in any license year at any location within the B (Business), O (Office and Research), and/or M (Manufacturing and Industrial) Zoning Districts within the Village shall be subject to the licensing requirement of this chapter if by himself, herself or itself, or through an agent, employee or partner, he, she or it holds himself, herself or itself forth as being engaged in a business or occupation; or solicits patronage therefor, actively or passively; or performs or attempts to perform any part of such business or occupation in the Village and all such persons shall obtain from the Village the required business license as herein provided for, and pay to the Village the required annual non-refundable business license fee, provided however, no business license shall be required for: 1) a "church" as defined in section 8-2-2, "Definitions", of title 8 of this Village Code or a not-for-profit corporation which has tax-exempt status, or 2) a lawful "home occupation" as defined in section 8-2-2, "Definitions", of title 8 of this Village Code which is conducted in compliance with this chapter and with section 8-3-5 of this Code.
   B.   Disclosure Of Tenants: Notwithstanding anything contained in this chapter to the contrary, the license required for all businesses and/or occupations, other than home occupations, pursuant to subsection A of this section shall not be applicable to the activity of leasing as a lessor of premises for use by others, when such premises are properly zoned for such use, pursuant to the applicable provisions of title 8 of this Village Code, but each person, partnership, corporation, association or land trust or beneficiary of a land trust which has, as a lessor, leased any premises within the Village for any purpose other than residential or agricultural uses shall annually and not later than June 1 of each year submit a sworn list of all tenants who were using or occupying such leased premises for any purposes other than residential or agricultural uses, on the preceding May 1 or during any time during the twelve (12) calendar months preceding said May 1 date. The beneficiaries of any land trust which fail to comply with the requirements of this subsection shall also be culpable for such violations and jointly and severally liable for any fines or other penalties imposed pursuant to this chapter. Such disclosure of tenants shall be on a form obtained from the Village Clerk and shall include the name, address, telephone number and an accurate description of the business or activity of each tenant.
