§ 95.06 TREE AND SHRUB PROTECTION.
   This section applies to any work or activity which may impact public property trees or shrubs.
   (A)   Unless otherwise authorized by this section, it shall be unlawful for any person to remove, chemically spray or treat, injure or undertake any procedure which will cause death, substantial damage, or create a hazard, to any public property tree without first obtaining a tree permit from the Village of La Grange Park. In the case of tree management practices, these practices shall comply with the requirements identified in the Urban Forest Management Plan.
   (B)   In the event of any site improvement which may impact public property trees, a tree preservation plan is required, must be approved, and implemented prior to the start of any work or delivery of any materials to the building activity area. The approved tree preservation plan shall be available on the site throughout the entire construction period until final approvals for all site work shall be received in writing.
   (C)   In instances where the activity requires the use of heavy equipment, and where that activity may impact trees on public or private property, all appropriate tree protection measures must be taken and identified in the tree preservation plan, including protection to a trees critical root zone. In addition, all tree protection measures shall be in compliance with the Urban Forest Management Plan.
   (D)   It shall be unlawful to injure any tree or shrub planted in any public place. All construction projects within or adjacent to the public ways, and that have a potential impact on existing public trees or shrubs, will require a permit authorized by the Director of Public Works.
   (E)   Any person or company given the right to maintain poles and wires in the streets, alleys or other public places in the village shall, in the absence of provisions in the franchise concerning the subject, keep the wires and poles free from and away from any trees or shrubs in such places so far as may be possible, and shall keep all such trees and shrubs properly trimmed and subject to the supervision of the Director of Public Works, so that no injury shall be done to the poles or wires or shrubs and trees by contact.
   (F)   It shall be unlawful to attach any sign, advertisement or notice to any tree or shrub in any street, parkway or other public place.
   (G)   It shall be unlawful to attach any wire or rope to any tree without permission of the Director of Public Works.
   (H)   Any person maintaining any gas pipes in the village shall, in the absence of provision in the franchise concerning the subject, keep the pipes free from leaks so that no injury shall be done to any tree or shrubs.
