§ 73.06 OFFICERS TO WEIGH VEHICLES, REMOVE EXCESS LOADS.
   (A)   Any police officer having reason to believe that the weight of a vehicle and load is unlawful shall require the driver to stop and submit to a weighing of the same either by means of a portable or stationary scales. If the scales are not available at the place where the vehicle is stopped, the police officer shall require that the vehicle be driven to the nearest public scales.
   (B)   Whenever an officer upon weighing a vehicle and load, as above provided, determines that the weight is unlawful, the officer shall require the driver to stop the vehicle in a suitable place and remain standing until the portion of the load is removed as may be necessary to reduce the gross weight of the vehicle to such limit as permitted under this chapter and shall forthwith arrest the driver. All material so unloaded shall be cared for by the owner or operator of the vehicle at the risk of the owner or operator.
   (C)   Any driver of a vehicle who fails or refuses to stop and submit the vehicle and load to a weighing, or who fails or refuses when directed by an officer upon weighing of the vehicle to stop the vehicle and otherwise comply with the provisions of this section, shall be guilty of a misdemeanor.
   (D)   Whenever the gross weight of the vehicle and load is in compliance with ILCS Chapter 625, Act 5, § 15-111 and its axle load is in excess of not more than 1,000 pounds of that permitted by ILCS Chapter 625, Act 5, § 15-111(a), the owner or operator of the vehicle shall be permitted to shift the load on the vehicle to comply with the limits prescribed by ILCS Chapter 625, Act 5, § 15-111(a). In such case, no arrest ticket shall be issued to the owner or operator of the vehicle by any police officer.
