(A) Mobile food vendors must operate in compliance with all village codes and ordinances as well as all applicable county, state, and federal regulations. Mobile food vendors shall observe all local, county and state traffic codes and parking regulations.
(B) (1) No mobile food vendor shall operate in a location that:
(a) Substantially obstructs a public right-of-way, as determined by the village;
(b) Impairs the movement of pedestrians or vehicles;
(c) Poses a hazard to public safety;
(d) Is within 30 feet of an intersection;
(e) Is within three feet of a driveway or curb cut.
(2) In the event that a mobile food vendor can demonstrate that meeting the criteria listed in division (B)(1)(d) above would impose undue hardship, alternate locations may be approved on a case-by-case basis by the Village Manager or his or her designee.
(C) Mobile food vendors shall be required to pay all required sales tax and shall provide, on request, records of sales and payment of sales taxes. Mobile food vendors shall complete and file all required sales tax returns and other reports as required by state law.
(D) Mobile food vendors shall not be located in such close proximity to a vehicular access drive, sidewalk, or railroad track so as to create a safety hazard, as determined by the village.
(E) The Village Manager is hereby authorized and directed to communicate with ice cream truck vendors and take other necessary measures to prohibit ice cream trucks from entering or stopping an area that lies within a one block radius of any elementary, junior, or high school within the time period beginning one hour before school starts and one hour following school dismissal every day school is in session. Ice cream truck vendors found in violation of this section shall be fined for each day of violation in an amount ranging from $75 to $100.
(F) Mobile food vendors shall only sell food and beverages. The sale of other merchandise or goods shall not be permitted. The sale of alcohol by mobile food vendors is prohibited, unless expressly permitted as part of a special event approved by the village, in which case the appropriate village liquor license shall be required.
(G) The village may suspend or revoke any mobile food vendor license for any violation(s) of this subchapter.
