(A) All charges for garbage collection due under this chapter and any applicable franchise ordinances shall be due at the same time as the payment of the utility bills with the city’s Utility Commission.
(B) After the tenth of the month, the Utility Commission may charge a 10% penalty on unpaid balances and said penalty goes to the Utility Commission up to 30 days stated in division (C).
(C) Charges remaining due and unpaid for a period of 30 days after they become due shall be deemed delinquent and shall be subject to interest on said amount at 12% per annum until paid.
(D) Failure to pay the outstanding charges for a period of 90 days may result in the Utility Commission filing an action in the County District Court for collection of the unpaid charges.
(E) Failure to pay the outstanding garbage collection charges and fees or judgment after the 90-day period referred to in division (C) of this section for a period of 45 days may result in the utility service to the offending residence being terminated until such charges are paid.
