§ 150.99 PENALTY.

   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.

   (B)   It is hereby made the duty of any person, firm or corporation to comply with the terms of § 150.01 of this chapter and any person, firm or corporation violating any of the provisions of § 150.01 of this chapter shall be guilty of a misdemeanor and shall suffer the penalties of § 150.01 of this chapter as hereinafter set out, to-wit: any violation of any provisions of § 150.01 of this chapter shall constitute a Class B infraction and a fine to be levied against such persons, firm or corporation in the amount of not less than $75, plus any and all attorneys’ fees and costs of collection for each day of violation.

   (C)   Any person who shall continue any violation beyond the time limit provided for in the Council’s notice, per § 150.02 of this chapter, shall be guilty of a Class A infraction and, on conviction thereof, shall be fined in an amount not exceeding $100 per day for said violation, plus any and all attorneys’ fees and costs of collection, with each day that such violation continues being deemed a separate offense.

   (D)   Any violation of § 150.03 of this chapter shall be deemed a Class A infraction and shall, upon conviction thereof, be fined in an amount not to exceed $50, plus any and all attorneys’ fees and costs of collection. Each day a violation of this chapter exists shall be deemed a separate infraction.

   (E)   Any such house found without numbers, per § 150.07 of this chapter, shall be notified by the Town Marshal of the failure to sufficiently number said home and, if in two weeks of such notice, such house has not become numbered, the owner of such house shall be deemed to have committed a Class D infraction and shall be fined in a sum not to exceed $25, plus all attorneys’ fees and costs of collection. Each day following the 14-day warning period shall be considered a separate offense subject to the above stated fine.

   (F)   Any person violating the provisions of § 150.08 of this chapter commits a Class A infraction and shall, upon conviction thereof, be fined in an amount not to exceed $100, plus any and all attorneys’ fees and costs of collection. All fines shall be payable upon conviction of same for each day that any violation of § 150.08 of this chapter should continue.

   (G)   Violations of §§ 150.20 through 150.23 of this chapter shall be addressed as established in I.C. 36-7-9, as it may be amended from time to time. Any party found to have violated §§ 150.20 through 150.23 of this chapter shall reimburse the town all reasonable expenses incurred in administration and enforcement of §§ 150.20 through 150.23 of this chapter; professional, legal and otherwise; as relates to such violation.

   (H)   (1)   Pursuant to I.C. 36-1-6-4, the city may initiate a civil action in a court of competent jurisdiction to restrain any person from violating a provision of §§ 150.35 through 150.47 of this chapter.

      (2)   Any person violating any provision of §§ 150.35 through 150.47 of this chapter may be subject to a fine in any sum not exceeding $2,500. The assessment of a monetary penalty shall in no way limit the operation of the penalties provided elsewhere in §§ 150.35 through 150.47 of this chapter.
