(a) Temporary Water Service. Upon the payment of a fee as determined by ordinance, the Village of LaGrange shall provide water service to premises during the period of construction of residential, commercial and industrial improvements thereon. Use of such water shall be restricted to those activities directly related to the construction of said improvements and shall under no circumstances be used for the maintenance of landscaping or other vegetation on or about the premises.
(b) Misuse of Temporary Water. Misuse of temporary water service shall constitute grounds for the termination of such service in accordance with the termination procedures set forth herein. Upon such termination, the Village Utilities Department shall assess the cost of water consumed on the Premises in accordance with Section 921.05
.
(c) Application for Water and Sanitary Sewer Service. Within three business days after the date of final inspection, the developer, builder or its representative shall make application to the Village Utilities Department for water and sanitary sewer service to the premises.
(d) Termination of Temporary Water Service - Procedure. A written notice of termination of temporary water service shall be provided to the contractor, builder or its representative on the date of the final inspection of the improvements. Said notice shall provide that temporary water service shall terminate no sooner than 4:00 p.m. on the third business day following the date of final inspection. Said notice shall further provide that the party to whom such notice is issued shall be entitled to make objections to said termination of temporary water service by delivering written notice of said objections to the Village Utilities Clerk within said three-day period. The objections shall contain a brief statement of the reasons for said objections, and if desired, a request to be heard in person on said objections. The Village Utilities Clerk shall forthwith forward a copy of said objections to the Village Mayor for consideration. If requested, the Mayor shall provide the objecting party with an opportunity to appear in person to state his or her objections before any decision is made regarding those objections. Temporary water service shall not be terminated until such time as the Village Mayor shall make a decision regarding the objections. In the event the Village Mayor is absent or is otherwise unable to consider said objections, then said objections shall be heard and decided by the President of Council Pro Tem.
(e) Issuance of Occupancy Permit. In addition to any other requirement or condition to the issuance of a temporary or permanent occupancy building permit, no such permit shall be issued until and unless an application for water service and sanitary sewer has been made and approved by the Village Utilities Department.
