§ 114.20 LIVE ENTERTAINMENT.
   (A)   It shall be unlawful to provide live entertainment and/or live music in an establishment licensed to sell alcoholic liquor for consumption on the premises, unless:
      (1)   The proprietor of the establishment personally requests a permit form from the City Clerk; and
      (2)   Approval is given to the request for live entertainment and/or live music at least five days prior to the planned event.
   (B)   All applications for live music and/or entertainment permits must recite on the application whether they are for outdoor or indoor events. Approval of indoor events shall be made by the City Clerk and Chief of Police and approval for outdoor events shall be made by the City Council.
   (C)   INDOOR EVENTS are defined as those events which are contained within permanent buildings whereby the sound will be contained within permanent buildings whereby sound will be contained by the roof and walls of said building so as not to pass across the boundaries of said real estate into residential and adjoining real property areas.
   (D)   OUTDOOR EVENTS shall be defined as all entertainment which is located on open grounds, parks, bandstands or structures which are partially open to the outdoors where sound can be transmitted without structural impediments.
   (E)   No permits granting live entertainment and/or live music shall be issued granting the playing of outside live music after the hours of 11:00 p.m., Sunday through Thursday, inclusive, nor later than 12:00 p.m. Friday and Saturday, inclusive.
   (F)   If any premises have recorded music which can be heard off said premises, that this shall also constitute a violation under this chapter after the hours enumerated above.
   (G)   This chapter shall not apply to private residences, churches and school related activities.
   (H)   Upon application to the City Council, different types of permits may be granted for special events provided that all such licenses and permits shall be issued uniformly to applicants applying therefore.
