§ 10.99 GENERAL PENALTY.
   (A)   Whoever violates any provision of this code or other ordinance of this city for which another penalty is not specifically provided, shall be fined not less than $250 or more than $750 for any code violation occurrence where another fine is not specifically provided, and each day the violation continues shall constitute a separate offense.
   (B)   Settlement.
      (1)   Unless otherwise provided in this code or city ordinance, any person accused of violation of any provision of this code or any city ordinance punishable by a fine may settle the violation by paying the penalty assessed in the violation notice and report for such violation within 21 days of receipt of the violation notice and report. Payments to the city shall be made to either the City of Lacon City Clerk or City Treasurer, 406 5th Street, Lacon, IL 61540.
      (2)   Upon the failure to timely pay the settlement amount, the person accused of violation of the code or any city ordinance shall be required to appear in the Circuit Court of Marshall County in Lacon, Illinois, at the time, date, and place set forth on a notice to appear or a subsequently issued notice to appear, as applicable.
      (3)   The settlement option does not preclude the city from taking any other action authorized by this code or any city ordinance, or by federal or state law, against a person accused of violation of this code or city ordinance. Additionally, the city’s Prosecuting Attorney may refuse/refund settlement payments if the Prosecuting Attorney believes that such settlement would not be in the best interest of the city or its citizens.
