5-8-3: PLACEMENT REQUIREMENTS:
   A.   Receptacles: Persons placing debris, garbage, litter, rubbish or refuse in public or private receptacles shall do so in such a manner as to prevent it from being blown, carried, scattered or deposited by the elements upon any street, sidewalk or other public place or upon private property. Such receptacles must be tightly covered containers as specified in subsection 5-7-5A1 of this title.
   B.   Premises Maintained: The owner or person in control of any private property shall at all times maintain the premises free of debris, garbage, litter, rubbish and refuse; provided, however, that this subsection shall not prohibit the storage of such debris, garbage, litter, rubbish and refuse provided it is deposited in tightly covered containers as specified in subsection 5-7-5A1 of this title and made available for easy collection.
   C.   Unauthorized Removal: It shall be unlawful for any person to remove or move any receptacle for the placing of debris, garbage, litter, rubbish or refuse from any private or public property in the city. This subsection shall not apply to any authorized city employee or agent, or to the person owning the property or placing the receptacle thereon. (Ord. 47, 5-21-1973; amd. 2005 Code)
