§ 55.242 SHOW CAUSE ORDERS.
   The Superintendent may order a user which has violated, or continues to violate, any provision of this chapter, an individual or general wastewater discharge permit, or order issued hereunder, or any other pretreatment standard or requirement, to appear before the Superintendent and show cause why a proposed enforcement action should not be taken. The show cause order shall be served on the user and shall specify the time and place for the meeting, the proposed enforcement action, the reasons for such action, and include a request that the user “show cause” or otherwise provide evidence in support of their case that the proposed enforcement action should not be taken. The show cause order shall be served personally or by registered or certified mail (return receipt requested) at least seven calendar days prior to the hearing date. The show cause order may be served on any authorized representative of the user as defined in § 55.004 and required by § 55.156. A show cause order shall not be a bar against, or prerequisite for, taking any other action against the user.
