§ 55.216 SEARCH WARRANTS.
   (A)   If the Superintendent has been refused access to a building, structure, or property, or any part thereof, and is able to demonstrate probable cause to believe that there may be a violation of this chapter, or that there is a need to inspect and/or sample as part of a routine inspection and sampling program of the city designed to verify compliance with this chapter or any permit or order issued hereunder, or to protect the overall public health, safety and welfare of the community, the Superintendent may seek issuance of a search warrant from the court of competent jurisdiction within the City of Kokomo and/or Howard County, Indiana.
   (B)   Where the Superintendent requires a search warrant for the reasons in division (A) above, the Corporate Counsel for the City of Kokomo shall file the appropriate application with the court of competent jurisdiction within the City of Kokomo and/or Howard County, Indiana. The presiding judge shall issue a search and/or seizure warrant describing therein the specific location subject to the warrant. The warrant shall specify the extent and limitation of the activities authorized to be conducted by the Superintendent on the property described. Such warrant shall be served at reasonable hours by the Superintendent in the company of a uniformed police officer from the law enforcement agency specified by the judge issuing the warrant.
   (C)   In the event of an emergency affecting public health and safety, inspections shall be made without the issuance of a warrant. Such inspections shall, if necessary, be coordinated with the appropriate law enforcement agency or other emergency response agency having jurisdiction within the City of Kokomo and/or Howard County, Indiana.
