The city and the city MS4 operator shall administer, implement, and enforce the provisions of this subchapter under authority granted by I.C. 36-1-4, 36-1-6, 36-7-4, 36-8-2, 32-30-6; and all acts supplemental and amendatory thereto. Any powers granted or duties imposed upon the authorized enforcement agency, may be delegated in writing by the city MS4 operator, to persons or entities acting in the beneficial interest of or in the employ of the city MS4. The requirements and, or provisions of this subchapter do not pre-empt or limit more stringent stormwater management requirements, and/or regulatory powers, of any other lawful regulatory governing body.
