(A) The city, in its capacity as an MS4 operator, is required by 327 IAC 15-13-14(c) to adopt an ordinance to prohibit illicit discharges into MS4 conveyances, and to establish appropriate enforcement procedures and actions.
(B) Therefore, the purpose of this subchapter is to provide for the health, safety, and general welfare of the citizens and environment of the city through the regulation of non-stormwater discharges to the storm drainage system to the maximum extent practicable as required by federal and state law. This subchapter establishes methods for controlling the introduction of any illicit discharge into the municipal separate storm sewer system (MS4) within the city in order to comply with requirements of the National Pollutant Discharge Elimination System (NPDES) permit process.
(C) The objectives of this subchapter are:
(1) To regulate the contribution of pollutants to the municipal separate storm sewer system (MS4) by stormwater discharges by any user.
(2) To prohibit illicit connections and discharges into the municipal separate storm sewer system.
(3) To establish legal authority to carry out all inspection, surveillance and monitoring procedures necessary to ensure compliance with this subchapter.
(D) This regulation shall be known and cited as the City of Kokomo Separate Storm Sewer System (MS4) Illicit Discharge Ordinance.
