4-2-4: USER CHARGES:
   A.   Use Of Treatment Works: Each user shall pay for the services provided by the City based on the user's use of the treatment works as determined by water meter(s) acceptable to the City. Said charges shall include a monthly water usage charge, a surcharge and a minimum charge.
   B.   Monthly Water Usage Charge And Base Charge: Contributors will pay a monthly user charge based on the monthly water usage by the contributor during the current month. The user charge rate is for operation and maintenance of the system including replacement and debt service. The rate, which is set out below, is per one thousand (1,000) gallons of water used. In addition to the monthly water usage charge, each contributor shall also pay a base charge per month, which is set out below:

      1.   If a commercial, residential or industrial contributor has a consumptive use of water, or in some other manner uses water which is not returned to the wastewater collection system, the user charge for the contributor may be based on a wastewater meter(s) or separate water meter(s) installed and maintained at the contributor's expense, and in a manner acceptable to the City.    C.   Major Contributing Industry Violations:

Upon receipt of the Notice of Violation the company shall file a written response with the Waste Water Superintendent explaining the actions that will be taken by the company to eliminate the discharge of pollutants.

Example:
Actual BOD on day test is 680 pounds per day.
Form 31 or pretreatment agreement limit is 500 pounds per day.
This is the first fine in the last 90 days.
The fine would be:
$1,000.00 x (680/500) = $1,360.00
In addition, if pretreatment violations by a major contributing industry cause permit violations by the City, the industry will be responsible for costs incurred by the City.
   D.   Commercial Surcharge: A surcharge factor shall be levied for the following customers whose wastewaters exceed normal domestic wastewater:

For those customers categories not listed, the City shall establish the new category.
   E.   Sampling Charge: Those industrial and commercial contributors who contribute wastewater which is monitored by the City shall pay a sampling charge of one hundred dollars ($100.00) per month in addition to the above described user charges. For tests completed by outside certified laboratories, contributors will be charged the cost of the required testing by the City's NPDES permit under a five (5) year contract executed by the Wastewater Division plus the one hundred dollar ($100.00) charge.
   F.   Increased Costs: Any user which discharges any toxic pollutants which cause an increase in the cost of managing the effluent or the sludge from the City's treatment works, or any user which discharges any substance which singly or by interaction with other substances causes identifiable increases in the cost of the operation, maintenance, or replacement of the treatment works, shall pay for such increased costs. The charge to each such user shall be as determined by the City Manager and approved by the City Council.
   G.   Application Of Charges: The user charge rates established in this chapter apply to all users, regardless of their location, of the City's treatment works.
   H.   Grease Trap Inspection Charge: Those contributors who contribute wastewater that require a grease trap that is monitored by the City shall pay an inspection charge of eight dollars thirty five cents ($8.35) per month in addition to the above described user charges, to pay for the inspections done twice per year. The seasonal contributors that have inspections only once per year shall pay the inspection charge of four dollars seventeen cents ($4.17) per month to pay for the inspection done once per year.
