An employee of a retailer who sells, gives, or otherwise supplies any tobacco, tobacco products, or cigarettes to any individual under the age of eighteen (18) is guilty of a simple misdemeanor 1 .
If an employee violates the provisions of this section, the schedule of penalties shall be as follows:
A. For a first violation, the scheduled fine is one hundred dollars ($100.00).
B. For a second violation, the scheduled fine is two hundred fifty dollars ($250.00).
C. For a third or subsequent violation, the scheduled fine is five hundred dollars ($500.00) 2 . (Ord. 01-05, 4-16-2001)
