4-3-11: INSURANCE REQUIREMENTS:
The recyclable, garbage and refuse hauler shall not be permitted to commence work under this chapter until recyclable, garbage and refuse hauler has obtained all required insurance and filed proof of such with the city clerk. Neither shall the recyclable, garbage and refuse hauler allow any subcontractor to commence work until all similar insurance required of the subcontractor has been so obtained and approved.
   A.   Compensation Insurance: The recyclable, garbage and refuse hauler shall take out and maintain workers' compensation insurance for all employees of the business. In any case, where work subject to the workers' compensation act is subcontracted, the recyclable, garbage and refuse hauler shall require any subcontractor to provide workers' compensation insurance for all the latter's employees unless such employees are covered by the protection afforded by the recyclable, garbage and refuse hauler.
   B.   Public Liability And Property Damage Insurance: The recyclable, garbage and refuse hauler shall obtain and maintain such public liability and property damage insurance as shall protect him from claims for damages for personal injury, including accidental death, as well as property damages which may arise from operations under this chapter, whether such work is performed by the recyclable, garbage and refuse hauler or by any subcontractor or by anyone directly or indirectly employed by either of them and the amount of such insurance shall be as follows:
Public liability insurance in an amount not less than one million dollars ($1,000,000.00) for injuries, including accidental death to any one person, and subject to the same limit for each person, in an amount not less than one million dollars ($1,000,000.00) on account of one accident, and property damage insurance in an amount of not less than one million dollars ($1,000,000.00).
The recyclable, garbage and refuse hauler shall require each and every subcontractor to obtain and maintain similar policies with the same limits stipulated above.
   C.   Comprehensive Vehicle Liability Insurance: The recyclable, garbage and refuse hauler (and any subcontractor) shall obtain prior to commencement of work under this chapter comprehensive vehicle mobile liability insurance in the following amounts:
      1.   For injury to or death of persons, not less than one million dollars ($1,000,000.00) to or for any one person and one million dollars ($1,000,000.00) for any one accident, and
      2.   For injury to or destruction of property not less than one hundred thousand dollars ($100,000.00) for any one accident, where such loss arises by reason of ownership, maintenance, operation, use, loading and/or unloading of any vehicle. Such insurance shall be applicable to each and every truck or other vehicle used in hauling garbage or recyclable materials or as otherwise used in the performance of work under or in connection with this chapter.
   D.   Umbrella Liability Coverage: The recyclable, garbage and refuse hauler (and subcontractor) shall further obtain and maintain umbrella liability coverage with the same limits of liability as specified in subsection B of this section providing excess insurance over and above the basic automobile policy referred to in subsection C of this section.
   E.   Proof Of Carriage Of Insurance: Prior to commencement of work, hereunder, the recyclable, garbage and refuse hauler shall furnish to the city clerk the certificates of insurance relating to all required coverage.
   F.   Cancellation Of Insurance: Each policy shall provide that it is noncancelable for a period of thirty (30) days following written notice of intention to cancel given to the city by certified mail. (Ord. 01-15, 12-17-2001)
