4-2-10: NEWBOLD DRIVE SERVICE AREA SANITARY SEWER CONNECTION FEE DISTRICT:
The Newbold Drive service area sanitary sewer connection fee district is hereby established, consisting of a tract of land in lot 1 and lot 2 of Knoxville Industrial Park and lots 7 through 15 in Reimer Subdivision, both official plats, now included in and forming a part of the city of Knoxville, Marion County, Iowa, as graphically depicted on figure 1 attached to the ordinance codified herein on file in the office of the city clerk and made a part hereof.
Connection fees are hereby established and shall be imposed upon owners of properties within the Newbold Drive service area sanitary sewer connection fee district, pursuant to ordinance, at the time of application to connect their properties to said sewer facilities, as follows:
   A.   Fee Schedule: From the effective date hereof, a connection fee based upon the following formula:
 
Total cost of Newbold Drive sanitary sewer extension
54.23 acres
 
The "total cost of Newbold Drive sanitary sewer extension" will include the bid price of the Newbold Drive sanitary sewer extension project in the amount of one hundred fourteen thousand eight hundred sixty eight dollars ($114,868.00) plus twenty four thousand dollars ($24,000.00) of engineering costs. Therefore, the "total cost of Newbold Drive sanitary sewer extension" is equal to one hundred thirty eight thousand eight hundred sixty eight dollars ($138,868.00).
From the effective date hereof, a connection fee as calculated in the fee schedule of two thousand five hundred sixty dollars ($2,560.00) per acre of property served by the sewer facility shall be imposed.
   B.   Exception: The above established connection fee schedule shall not apply to any properties within the Newbold Drive service area sanitary sewer connection fee district which do not use any sewer facilities constructed for the Newbold Drive service area sanitary sewer connection fee district.
   C.   Payment: The determination that a property is to be connected to the sewer facilities shall occur, and the appropriate connection fee shall be paid, prior to the time of release of a final plat for recordation or issuance of a building or plumbing permit, whichever occurs first.
   D.   Adjustment Of Fees: The above established connection fee schedule shall remain in force and effect until such time that the city council adopts an ordinance to adjust the connection fees to be imposed within subsequent years for the Newbold Drive service area sanitary sewer connection fee district. Nothing herein is intended to restrict the city council from appropriate adjustment of the connection fee schedule to reflect future construction costs. (Ord. 10-01, 4-19-2010)
