§ 51.05  INSTALLER LICENSE.
   (A)   No person shall construct, install, replace, repair or alter any part of an on-site sewage disposal system in the county until the person is licensed by the County Health Department as a licensed installer for the type of system to be installed.
   (B)   In order to become licensed, an individual must:
      (1)   File an application for license;
      (2)   Demonstrate knowledge of the applicable laws, rules and regulations before becoming licensed by passing a proficiency examination conducted by the County Health Department;
      (3)   Present a license of liability insurance issued by a company registered in the state showing coverage for the entire term of the license. The liability policy shall be sufficient to indemnify persons for whom faulty work may be performed or a minimum of $300,000;
      (4)   Present a surety bond issued by a company registered in the state showing coverage in the amount of $7,500. The surety bond shall be filed with the County Health Board who will control the proceeds of the same in the event a claim is made against the bond; and
      (5)   Pay an initial fee.
   (C)   Licenses issued hereunder shall be valid for a term of one year beginning January 1, and expiring December 31, of the same year and shall be renewed annually. The license shall bear the name and address of the licensed installer and the expiration date and shall not be transferable. Any license that is not renewed within one year of the expiration date shall be considered void and the installer must re-apply for the license and pass the proficiency test.
   (D)   The installer shall maintain in his or her possession a copy of the license at all times when installing on-site soil absorption systems.
   (E)   A licensed installer shall be on the site at all times during construction and shall be deemed responsible for the installation. A licensed installer may supervise other construction workers as necessary to assist in the installation.
   (F)   A property owner wishing to install, repair or otherwise work on the on-site sewage disposal system serving his or her own dwelling shall be required to demonstrate knowledge of the applicable laws, rules and regulations by taking the proficiency exam conducted by the Health Department.
