(A) The Highway Department shall review all plans submitted in accordance with § 151.21 and determine its findings in the matter. The Highway Department shall approve or conditionally approve all plans in compliance with the standards of this Ordinance, and good engineering practice standards. The Highway Department shall provide the applicant with written notice of its approval, disapproval or conditional approval of the plan.
(1) The decision of the Highway Department may be appealed to the Knox County Commissioners. A written request for such appeal must be filed with the Knox County Auditor within 30 days of receipt of the written notice from the Highway Department. The County Commissioners shall schedule a hearing on the appeal within 30 days of receipt of the request for appeal.
(2) Any Highway Department or County Commissioner approval shall be contingent on obtaining all necessary local, state and federal approvals or permits.
(B) Upon concluding the hearing of a drainage plan, the Board shall state its findings in the matter, and determine the approval, disapproval or conditional approval of the plan. The Board shall approve or conditionally approve all plans in compliance with the standards of this chapter, and good engineering practice standards. The Board will inform the applicant of its decision and any modifications or conditions upon which approval is contingent. The findings and decision of the Board will be entered in the official minutes of the meeting. Any Board approval shall be contingent on obtaining all necessary local, state and federal approvals or permits.
