(A) Temporary road closure may be granted only for a maximum one year and extended for an additional two-year periods. Applications for extensions must be submitted at least 60 days prior to the expiration of the present period of closure. The County Commissioners grant the request for temporary closing or crossing a road if they find that there is no compelling public interest in keeping the road open or in the immediate reopening of the road and further there would be significant harm to the applicant.
(B) All restored roads shall be returned to the county within one year after restoration and the applicant shall so notify the County Commissioners in writing that the road is ready to be reopened and request the county review the road for approval. No road shall be reopened until the county has reviewed the road and accepted the road, in writing, and so notified the applicant. The applicant shall pay the sum of $50 per day as liquidated damages to the county for every day the road is not reopened following the one-year period after the expiration of the road closure agreement. The applicant shall also be required to pay the county's reasonable attorney fees, court costs and reasonable expenses of litigation brought by the county to compel compliance with the reopening of county roads.
