§ 92.47  REQUIREMENTS; BONDS AND COSTS.
   (A)   All agreements on road crossings and temporary road closings shall provide:
      (1)   A bond in the amount of $100,000 per mile or any part thereof to cover the failure of the applicant to return the road to its original condition after the expiration or termination of the closing or crossing;
      (2)   Contain an indemnity clause;
      (3)   Require the applicant to maintain comprehensive liability coverage in a form acceptable to the County Commissioners covering the county and the applicant with limits of not less than $1,000,000 per incident;
      (4)   Provide for the applicant to pay all costs arising as a result of the agreement including suits initiated by the county against the applicant to compel compliance, suits in the form of administrative actions by a governmental agency and any suit by a third party seeking damages against the county;
      (5)   In the event of a temporary road closure, the applicant shall pay to the county, at the time of the execution or the agreement and order, the sum of $10,000 per mile or any part thereof of road closed for each closing per one year or any part thereof, subject to division (A)(6) below.
      (6)   A fee will be levied as follows on temporary road closures and road crossings of three weeks or less.
   (B)   No fee shall be charged for a temporary road closure or road crossing of less than one week (seven days from application):
      (1)   One to two weeks: $2,000;
      (2)   Two to three weeks: $5,000; and
      (3)   Three weeks: $10,000.
