§ 70.30 STREETS CLOSED TO TRAVEL DUE TO CLIMATIC CONDITIONS.
   (A)   The Superintendent of Public Works is hereby authorized to prohibit the operation of vehicles upon streets within the village’s jurisdiction, or to impose restrictions upon the weight of vehicles to be operated on the streets, for a total period of not to exceed 90 days in any one calendar year whenever the streets, by reason of deterioration, rain, snow or other climatic conditions, will be seriously damaged or destroyed unless the use of vehicles thereon is prohibited or the permissible weights thereon reduced.
   (B)   In making his or her decision pursuant to the provisions of division (A) of this section to prohibit the operation of vehicles upon streets or to impose restrictions upon their weight, the Superintendent of Public Works shall consider the following factors:
      (1)   The design standards of the street in question and the age of the street;
      (2)   The ambient air temperature at the time;
      (3)   The previous experience of the village in prohibiting the operation of vehicles upon streets or imposing restrictions upon the weight of vehicles to be operated upon the streets;
      (4)   The effect that the failure to prohibit the operation of vehicles upon streets or to impose restrictions upon the weight of vehicles to be operated upon those streets could have upon other streets within the jurisdiction of the village;
      (5)   The weight of vehicles which normally use those streets; and
      (6)   Such other factors as the Superintendent of Public Works considers relevant.
   (C)   (1)   After making a decision to prohibit the operation of vehicles upon roads or to impose restrictions upon their weight, the Superintendent of Public Works shall enter a written and dated order designating:
         (a)   The streets for which he or she is prohibiting the operation of vehicles or imposing restrictions as to weight of vehicles to be operated thereon; and
         (b)   The length of time for which the order is to be effective.
      (2)   The order shall also direct that signs be erected to enforce its provisions at appropriate locations sufficient to give vehicle operators notice of the weight restrictions.
   (D)   It shall be unlawful for the operator of any vehicle to fail or refuse to obey the instructions of any sign erected pursuant to the provisions of division (C) of this section unless otherwise directed by a law enforcement officer.
