§ 50.07 RATES.
   In order to provide a Department of Sanitation for the city and to finance the operations thereof, there is hereby established a schedule of fees, rates and charges for standard type of refuse, garbage and sanitation services within the city as follows.
   (A)   Minimum charge for services generally except commercial.
      (1)   The following rates are the minimum and are subject to adjustment for abnormally large volume. In this context, ABNORMALLY LARGE VOLUME shall be defined as being the collection of more than five 30- or 39-gallon garbage bags or ten 13-gallon garbage bags on each of two collection days in a one-month period. Should any residence paying minimum charge for collection experience an abnormally large volume of garbage and trash collection, the residential rate shall be adjusted and increased by the Supervisor of City Services in the same manner provided for commercial adjustments in division (C) below. Such minimum rates are applicable to and include one collection per week of prepared garbage and trash only:

      (2)   The term RESIDENTIAL HOUSEHOLD shall include each individual residence and each individual occupied apartment. No discount shall be given to buildings housing more than one residential household. Each residential household shall be billed as hereinbefore provided.
      (3)   All property owners of buildings which have multiple units and have only one water meter for the entire building shall be required to pay the refuse collection fee for each individual unit. In order for the landlord to be exempt from paying for a unit which is not rented/leased for at least one day of each billing period, the landlord shall file a statement of occupancy with the City Clerk on or before the fifteenth of each month. Should the landlord fail to file the statement of occupancy on or before the fifteenth day of each month, the property owner shall be billed for each unit within the building, regardless of whether it is rented/leased. A certificate of occupancy is attached hereto and made a part of this subchapter. There is further provided that should the owner of the building falsify any certificate of occupancy or fail to advise the city of the unit becoming rented/leased after the certificate of occupancy has been filed for the month, the owner shall be subject to violation of this subchapter and the penalties hereinafter set forth.
      (4)   All users who shall at any time during a one-year period suspend the use of this service and shall no longer make monthly payments for collection shall pay the amount of $15 to reinstate collection of refuse on a monthly rate and said reinstatement fee shall be applicable to all users when such use is suspended for less than a one-year term.
   (B)   Minimum charge for commercial services.
      (1)   Stores, hotels, restaurants, offices and other business and commercial establishments, multiple unit residential structures with a central refuse pickup point, mixed use structures with a central pickup point, factories and industries shall pay for the service a fee based upon the following schedule of rates and other contracts which may be so negotiated with the municipality.

      (2)   The fuel surcharge for within city and without city shall be as identified or such percentage amount as has been approved by the State Public Service Commission (PSC) for the fuel adjustment surcharge for all refuse collectors subject to review by the PSC, said amount to fluctuate up or down without further amendment of this subchapter, subject to notice of increase or decrease by the PSC.
      (3)   Any commercial services for all waste exceeding 40 yards per week shall be established by the Supervisor of City Services in accordance with costs which may be incurred for said commercial user and in consideration of the appropriate rationale used in accordance with establishing the rate for the afore referenced classes.
      (4)   The commercial rates as hereinbefore outlined shall be applicable to each individual business regardless of the number of businesses located in any one building.
   (C)   Bulky goods collection rates.

      (2)   The rates and charges for bulky goods collection are limited to those residential customers within the city certificated territory who reside more than one mile from any point or points along the present corporate limits of the city.
   (D)   Rates. The rates as hereinbefore established shall be the rates established for the refuse collection for commercial services for the classes as hereinbefore designated. In such circumstances as when a certain class may have special requirements or may be a combination of certain of the above classes or may not specifically relate to any of the specified classes, the Supervisor of City Services shall advise the commercial user as to the rate to be charged per collection for such specified commercial user, which said rate shall be established by said user and in consideration of the appropriate rationale used in accordance with establishing the rates for the aforereferenced classes.
   (E)   Notice.
      (1)   The Supervisor of City Services shall mail by United States mail to each commercial user a statement of the rate to be charged said user as herein established by this subchapter, which said notice of rate shall be mailed to each commercial user no less than 15 days prior to the effective rate charge, unless said 15 days are waived by said commercial user, and said notice to be made in advance of said collection.
      (2)   Any commercial user of this service who shall be aggrieved by a rate as established by the Supervisor of City Services or by the rate as established within this subchapter, may appeal such rate charge in writing to City Council within 30 days from and after the date of such appeal and after due notice to all parties in interest, shall hear such appeal at a public hearing at the regular meeting of Council and the decision of Council thereon shall be final.
   (F)   Refuse not collected. Under divisions (A) and (B) above, the city shall not collect, remove or dispose, nor shall the Sanitation Department or transfer station employees receive the following types of refuse: raw garbage; offal; sewage; animal excreta; the carcasses of animals; vehicles or parts of vehicles; tires; large tree stumps; materials determined by the Sanitation Superintendent to be hazardous or potentially hazardous or toxic; or materials resulting from the demolition, repair, alteration or erection of buildings or structures, or sand.
   (G)   Ashes.
      (1)   The city shall collect ashes one time each month, which date shall be established by the Supervisor of City Services to be a date certain in each month from the month of October of each year through and including the month of April of the following year. Only residents within the municipality may receive such service and must apply for such service prior to October of each year. Said recipients of this service shall pay in advance for the seven months of service at the time of application. The monthly fee for such ash collection shall be $5 for each month during the term of October through and including April. Any additional requested service in regard to ash pickup shall be considered a special pickup and shall be in accordance with special service charges as hereinafter provided. Removal of ashes by municipal employees shall be prohibited, unless such ashes is placed in cans of a size of ten gallons or less. Ashes places in any other type of container, including boxes shall not be serviced.
      (2)   Rates for all commercial users of the ash pickup service shall be established by the Supervisor of City Services after considering any special requirements of the commercial user and which said rates shall be in accordance with the costs which may be incurred for said commercial user and in consideration of the appropriate rationale used in accordance with establishing the rate for the household users.
   (H)   Rates for transfers by individuals or companies.

      (1)   Any special pick-up provided by the city will be at the rate of the per ton total weight rate plus $27 per hour, per worker regular time.
      (2)   (a)   Should the pick-up be on overtime hours, the per worker payment rate is $40.50 per hour.
         (b)   The special pick-up made for the City Volunteer Fire Department during the Preston County Buckwheat Festival shall be at the rate of the per ton total weight rate plus $27 per hour, per worker for four hours regular time for the pick-up made on Friday.
         (c)   The special pick-up made for the City Volunteer Fire Department during the Preston County Buckwheat Festival shall be at the rate of the per ton total weight rate plus $40.50 per hour per worker for eight hours overtime for each of the pick-ups made on Saturday and Sunday.
   (I)   Recovery of unpaid charges. If the fee, rate or charge for any of the foregoing services shall not be paid within 30 days after the same is due, the amount thereof may be recovered as provided by the law of the state.
   (J)   Special services.
      (1)   The city shall have the right to deny standard refuse service to any person whose refuse requirements are sufficiently abnormal or different, in the opinion of the County Health Officer, as to justify special handling in which case a special charge will be made.
      (2)   This shall include those buildings or dwellings not readily accessible to refuse collectors, or in cases where refuse is not found in standard containers.
   (K)   Placement of garbage; time limits. All items to be collected by the Sanitation Department, except household garbage, shall be placed for collection on the property line adjacent to the street or sidewalk not sooner than 12 hours prior to 6:00 a.m. on the day of the collection.
