STATE BUILDING CODE
The following State Building Code and certification and continuing education of building officials, inspectors and plans examiners are hereby adopted by reference as though they were fully set forth herein:
(A) Title 87, Series 4 State Building Code, including: 2015 IBC; 2015 IRC (delete Chapter 11); 2015 IEBC; 2015 IPC; 2015 IMC; 2015 IFGC; 2015 IPMC; 2015 ISPSC; 2014 NFPA 70 (NEC); 2009 IECC (Residential Energy); 2009 ICC/ANSI A 117.1 Standards for Accessibility; 2007 ANSI/ASHRAE/IESNA Standard 90.1 (Commercial Energy); and
(B) Title 87, Series 7 Certification and Continuing Education Building Officials, Inspectors and Plans Examiners.

BUILDING PERMITS; FEES
For buildings, additions to buildings, remodeling, repairs or renovations performed, demolition and excavation in regard to property, fences, signs, pools, accessory buildings and other structures within the municipality, as more accurately defined hereafter within this subchapter, the following shall be fees charged by the city for a building permit:
(A) A permit fee shall be $10 for construction costs ranging from $1 to $1,000;
(B) A permit fee shall be $20 for construction costs ranging from $1,001 to $2,500; and
(C) A permit fee shall be 0.5% of the cost of said construction work for construction costs in excess of $2,500.

(A) An applicant for a building permit shall first file an application therefor in writing on a form furnished by the city.
(B) Such application shall provide for the following:
(1) An identification and description of the work to be covered by the permit;
(2) Describe the land on which the proposed work is to be done by legal description and/or street address that will readily identify and definitely locate the proposed building or work;
(3) Indicate the use and occupancy for which the proposed work is intended;
(4) Be accompanied by construction documents/drawings that specifically set forth the type of work to be done and materials required;
(5) State the valuation of the proposed work including materials and labor;
(6) Be signed by the applicant or applicant’s authorized agent;
(7) Provide such other data and information as may be requested by the City Supervisor or City Council;
(8) A completed affidavit executed and notarized for all applicants who state that the applicant will be performing the work and that it is not being completed by any third party. Should other individuals assist with the repairs, a contractor’s license is required, even if the owner assists with the work; and
(9) A contractor’s name and license number shall be stated on the application for all work performed by any individual other than the owner. A contractor’s license shall be required on all commercial property even when the owner assists with the work with exception of non-structural, non- electrical projects costing less than $2,500 material and labor) and completed by the owner. If the commercial property is leased to any third party other than the owner, a contractor’s license is required, even when the owner does all of the work with exception of non-structural, non-electrical projects costing less than $2,500 (material and labor) and completed by the owner.
(C) The building permit fee shall be paid to the City Clerk at the time a building permit is issued and no building permit shall be granted until said fee is paid. Upon receiving a request for a building permit, the City Clerk shall provide the request to the City Supervisor for his or her review. The City Supervisor shall advise the Council in regard to his or her review and recommendation of the permit request. The City Supervisor may recommend the denial of the permit if, in his or her opinion, the valuation is underestimated on the application. In such a situation, the applicant would be requested to show detailed estimates to meet the approval of City Council. All building permits must be approved by the Council of the city prior to said permit being Issued, unless an emergency situation would occur. In the situation of an emergency, the City Supervisor shall inspect the area for which the building permit is requested and, if the Supervisor determines that an emergency does exist, the Clerk may issue the building permit upon the approval of the Supervisor. Only in emergency situations may the City Supervisor approve such a permit. Should the City Supervisor be not be available for inspection, any member of the City Council shall be permitted to approve such an emergency permit.
(D) All building permits issued shall conform to the zoning regulations, as codified in Chapter 152 of this code of ordinances, and all other applicable ordinances of the city.
(E) Every building permit issued shall expire and become invalid six months after the date of issuance. If the building permit specific work is not completed after six months, an extension can be granted for another six months totaling one year per permit. If after the extension a permitted project still requires additional time to complete, a justification and request for extension must be made in person by the original applicant or the applicant’s authorized agent before City Council. Any permit that expires without an authorized renewal shall be considered invalid and all work must cease until a new application for a building permit is submitted, approved, and issued in accordance with this chapter. If an emergency occurs that requires immediate work be done outside of normal city operating hours, the applicant or applicant’s authorized agent must retroactively request a permit on an emergency basis in accordance with this chapter on the next business day the city operated after the emergency. The city may suspend or revoke a building permit issued herein in error or on the basis of incorrect, inaccurate or incomplete information in violation of any ordinance of the city. The City Supervisor and/or City Council may issue a stop work order in writing and have the same delivered by the City Police Department to the applicant or person doing the work. Upon issuance of the stop work order, the cited work shall immediately cease. The stop work order shall state the reason for the order and the conditions under which the cited work will be permitted to resume.

(A) Should a permit be requested on an emergency situation and the City Supervisor determines that an emergency does not exist, the applicant shall pay to the city a penalty.
(B) Should an individual, business entity, or licensed contractor fail to obtain a building permit prior to beginning any work requiring such a permit, the individual, business entity, or licensed contractor shall be fined and the city police shall have the right to issue a stop and cease work order until such time as the fine is paid in full and an appropriate building permit is obtained in accordance with the provisions of this subchapter.
(C) Should any person continue to perform work when a building permit has been suspended or revoked through the issuance of a stop work order, except such work as that person is directed to perform to remove a violation or unsafe condition, he or she shall be subject to be fined for each day that the work continued after the issuance of the stop work order.

(A) A building permit shall be required to be obtained by the owner or authorized agent for the construction of buildings/homes, additions/alterations to buildings/homes, remodeling, repairs or renovations performed, moving of a building/home, demolition and excavation in regard to property, fences, signs, pools, accessory buildings and other structures within the municipality.
(B) Certain actions requiring a building permit are included specifically herein, but not exclusively to other actions which may be determined to require such a permit, which actions are the following construction/excavation activities:
(1) Construction and/or repair of driveways;
(2) Any structural modification of a building/home;
(3) Any electrical work within/without a building/home;
(4) Any furnace replacement/installation, all heating plants including, but not limited to, pellet stoves and wood burners;
(5) Any natural gas work performed within the building/home;
(6) Floor replacement within a building/home;
(7) Extensive remodeling/replacement of kitchen and bathroom;
(8) Extensive remodeling, including cutting away or removal of walls, partitions, structural beam or load-bearing support, or the removal or change of any required means of egress or rearrangement of parts of a structure affecting the egress within a building/home;
(9) All exterior work including, but not limited to, roof repair/replacement, gutters and shutters, fencing, pools (above and in-ground) and accessory buildings;
(10) All plumbing work within/without a building/home;
(11) Any mechanical work within/without a building/home; and
(12) Addition to, alteration of, replacement or relocation of any standpipe, water supply, sewer, drainage, drain leader, gas soil, waste vent or similar piping, electrical wiring or mechanical or other work affecting public health or general safety.
(13) Signs including those painted on building. See § 152.049.
(C) Building permits shall not be required for the following, which list is not exclusive:
(1) Construction/repair of sidewalks, exterior and interior painting, playground equipment and window awnings;
(2) Minor electrical repair work, including replacement of lamps or the connection of approved portable electrical equipment to approved permanently installed receptacles;
(3) Electrical equipment used for radio and television transmissions, but a permit is required for equipment and wiring for power supply and the installation of towers and antennas;
(4) Portable gas heating appliance;
(5) Replacement of a minor gas part that does not alter approval of equipment or make such equipment unsafe;
(6) Portable heating, ventilation and cooling units/equipment;
(7) The stopping of leaks in drains, water, soil, waste or vent pipe; however, should such trap, drainpipe and the like become defective requiring to remove and replace, such work shall require a building permit;
(8) The clearing of stoppages or the repairing of leaks in pipes, valves or fixtures and the removal and reinstallation of water closets, provided such repairs do not involve or require the replacement or rearrangement of valves, pipes or fixtures; and
(9) Ordinary repairs to structures, replacement of lamps or connection of approved portable electrical equipment to approved permanently installed receptacles.
