(A) The court shall be presided over by a Municipal Judge who shall be appointed by the Council for a term not to exceed four years and shall receive such compensation as determined by Council. Before entering upon the discharge of the duties of his office, he shall take and subscribe the oath of office prescribed by Article VI, Section 5, of the South Carolina Constitution. The Judge shall not be required to be a resident of the town.

(B) The Council may appoint a competent person as Acting Judge during the absence, sickness, incapacity or other disqualification of the Municipal Judge.
