(A) The town will be responsible for maintaining all public utility services in proper working order. The town will also be responsible for the maintenance, operations and improvements to common areas and those areas which serve the leased parcels, such as parking lots, sidewalks, lighting and the like.
(B) The developer shall be responsible for the maintenance, operations and improvements of their property, including buildings, plazas, amenities and the like which are not under the control of the town.
(C) The town shall have the authority to issue fines to be levied against the developer if property is not maintained in an appropriate manner.
