(A) In exercising his or her authority to designate fire lanes at a particular location, the Fire Marshal shall consider the following factors:
(1) The availability of alternative areas of access by firefighting vehicles to the particular property of facility involved in the case of fire, without the need for a fire lane;
(2) The susceptibility of the property or facility involved to fire damage and the effect of the damage on the public; and
(3) The gravity of the harm that would be caused to persons and property in case of fire at the particular structure, property or facility around which fire lanes are designated.
(B) Upon consideration of the above factors and the purposes of this subchapter, the Fire Marshal may attach reasonable conditions to the approval of the fire lanes as deemed necessary to further the purposes of this subchapter.
