§ 96.076 SMOKING PROHIBITED IN MUNICIPAL BUILDINGS.
   (A)   It shall be unlawful for any person to smoke in any building or facility or portion of a building or facility now or hereafter owned, leased, operated, occupied, managed or controlled by the city, except in specially designated smoking areas. The City Council shall have the authority to designate by resolution smoking areas within each city building or facility. An area within any building or facility may be designated as a smoking area only if the ventilation of the area is sufficient, any adverse impact on municipal employees and members of the public is minimal, and no fire or other safety hazard will be created by smoking in the area.
   (B)   There shall be a ban, restriction and prohibition against the use and/or smoking of a lighted pipe, cigar, cigarette or other combustible tobacco product at the walking tracks (Watterson Street and Cleveland Avenue); all Deal Street Park facilities, the park and playing fields; the Jake Early Complex in its entirety; Davidson Soccer Complex and all fields; and Patriot’s Park.
