§ 92.06  GENERAL REGULATIONS PERTAINING TO CONSTRUCTION, REPAIR, EXCAVATIONS, AND OBSTRUCTIONS.
   (A)   Proper bracing for excavations shall be maintained to prevent the collapse of adjoining lands.
   (B)   (1)   No injury shall be done to any pipes, cables, conduits, other underground structures, or any aboveground utility or sign in making excavations.
      (2)   Before making excavation in which the pipes, cables, or conduits may be disturbed, the person making the excavation shall give reasonable notice to the person maintaining the pipes, cables, or conduits.
   (C)   To the extent possible, provision shall be made for allowing the passage of pedestrian and vehicular traffic past the site of the work.
   (D)   After completion of excavation, all trenches and excavations shall be promptly backfilled and thoroughly settled by wetting and tamping, and all excess material promptly removed from the site.
   (E)   All openings, excavations and obstructions shall be properly barricaded and railed off, and provided with prescribed nighttime warning lights all in a manner so as to provide protection in a manner consistent with general industry practice or as further enhanced by direction of the Village Manager.  All traffic control devices shall conform to the Michigan Manual of Uniform Traffic Control Devices.
   (F)   Each day as work progresses, and after work is finished, all streets shall be thoroughly cleaned of excess earth and other debris resulting from the work, at the expense of the person receiving the permit.
   (G)   No provision of this chapter shall be construed to prevent the work as may be necessary for the preservation of life or property or for the location of improper or unsafe conditions in any conduit or pipe, or for making emergency repairs, provided that the person conducting the work shall apply to the Street Administrator or Village Clerk for an appropriate permit on the first working day after the emergency work is commenced.
   (H)   It shall be unlawful to disturb or to interfere with any barricade or railing lawfully placed to protect a mark ending new pavement, construction, excavation, or opening in a public street, curb, alley, sidewalk, or other public way.
   (I)   No person shall construct, reconstruct, repair, or remove any curb, gutter, or structure for regulating, governing, or facilitating the flow of water, except in accordance with the line, grade, or specifications established by the village.
   (J)   Any person receiving a permit for the work who shall fail to comply fully with all provisions of the permit, or other village ordinances, shall be subject to the suspension of the permit by the Village Manager or the Village Council.  In the event of the suspension, the person shall not proceed with the work for which the permit was issued until after the permit shall be reissued.
