The enforcement agent responding to a specific earth change as provided for in § 53.03 may waive certain requirements specified in this chapter upon being provided with demonstrable evidence of special circumstances warranting waiver, but only upon finding that both of the following requirements are met:
(A) The application of this chapter will present or cause practical difficulties for a development or development site; provided, however, that practical difficulties shall not include the need for the developer to incur additional reasonable expenses in order to comply with this chapter; and
(B) The granting of the relief requested will not substantially prevent nor result in less effective management of storm water runoff.
