(A) (1) No person shall solicit funds or secure subscriptions for the payment thereof within the village limits without first securing a permit from the Village Clerk.
(2) This section shall not apply to the charitable solicitations of any organizations which solicit funds solely from its own members or from its own assemblies not using public streets or public places for those purposes.
(B) An applicant for such a permit shall be required to truthfully provide the following information:
(1) The legal name of the organization applying for the permit and its address, and the name and address of any parent organization;
(2) The name, address, and telephone number of the person or persons who will be in charge of conducting the charitable solicitations campaign;
(3) The method or methods to be used in conducting the charitable solicitations campaign; and
(4) The period of time during which the charitable solicitations campaign shall be conducted, including proposed dates for beginning and ending the campaign.
(C) The applicant shall swear or affirm:
(1) That all money or other property collected, in excess of the cost to the organization or person of any goods sold or distributed as part of the charitable solicitations campaign, will be put to the use specified in the application for permit;
(2) That no person who will be soliciting charitable contributions will receive compensation based solely on the amount of contributions received by that person or the organization as a whole, or on the basis of the hours spent soliciting charitable contributions; and
(3) That the person or agents of the organization seeking charitable contributions will observe all ordinances of the village.
(D) (1) Upon providing the information and making the representations described in divisions (B) and (C) above, the Village Clerk shall issue a permit.
(2) All persons who are soliciting contributions shall keep a copy of that permit in their possession and shall exhibit it to any other person upon demand.
(E) It shall be unlawful to make any untruthful statement in connection with applying for a permit for solicitation of contributions.
