12.20.028: ACTIVITIES - EXCEPTIONS - APPLICATION AND FEE - PERMIT FEES - PUBLIC LIABILITY INSURANCE:
   A.   Any person or entity seeking to conduct commercial activity in a public park in the City must complete a written application form provided by the Planning and Zoning Administrator/CSO - Community Service Officer or designee. Each application under this section shall be accompanied by a nonrefundable fee of twenty five dollars ($25.00) and shall include the following information:
      1.   The name of the person or entity sponsoring the commercial activity.
      2.   The event if any, pursuant to which the commercial activity will be conducted.
      3.   Specific description of all commercial activities to be conducted.
      4.   The dates upon which the activities will be conducted.
      5.   The exact location within each public park where the commercial activity will be conducted and what time the subject park area will be occupied.
      6.   Applications shall be considered and acted on within ten (10) working days following the date of the submission of the completed application to the Planning and Zoning Administrator/CSO - Community Service Officer.
      7.   Security, additional portable restrooms, traffic control, parking, vehicles in the park, park irrigation and noise abatement arrangements.
      8.   Such other provisions as may be reasonably required.
      9.   This section shall not be construed to supersede any other provision of this Code requiring permits for the use of public parks.
   B.   Prior to the issuance of the permit, the applicant shall provide proof to the City of the placement of public liability insurance in an amount not to exceed the single-limit coverage of at least one million dollars ($1,000,000.00) of which policy the City has been made an additional insured. A permit shall further be issued subject to the understanding and acknowledgement by the applicant that by obtaining the permit it agrees to hold harmless and indemnify the City, from all liability which may arise from, touch or concern the commercial activity permitted by the City.
   C.   Should the Planning and Zoning Administrator/CSO - Community Service Officer approve the application, a permit fee shall be collected and a permit issued to the applying entity to conduct the commercial activity providing information as required in subsections A1 through A9 of this section.
   D.   The permit shall be effective upon its issuance by the Planning and Zoning Administrator/CSO - Community Service Officer or designee and upon payment of a fee to the City. The exact fee, if one has not been established shall be determined by the City Council upon adoption of an ordinance or resolution, taking into account the nature of the commercial activities to be conducted, number of patrons to be drawn to the commercial activity, the extent of the potential damage to the park by the commercial activity sought to be conducted, and such other reasonable factors as the City Council may deem appropriate.
