A. Every owner, tenant, or occupant of private property within the City shall cut and remove the weeds, grass and rubbish upon and from such private property to the center of any street or alley along or in front of such property including the parking areas within and the curbing abutting such property and to cut and remove the same as often thereafter during each year and every year as may be necessary and essential to prevent their growth, seeding, and becoming a fire hazard.
B. All private property will be maintained, mowed, or cut to keep the weed growth to no more than six inches (6") high and to prevent undesirable or uncultivated plant growth that is unkempt, unsightly or deleterious to the public. Every owner, tenant, or occupant of any premises or property shall be responsible to control any and all noxious weeds considered harmful to animals and the environment. Noxious weeds shall include, but not be limited to, the following: Buffalobur, Canada Thistle, Diffuse Knapweed, Dyer's Woad, Field Bindweed, Hoary Cress, Leafy Spurge, Mush Thistle, Perennial Pepperweed, Perennial Sowthistle, Poison Hemlock, Puncturevine, Rush Skeletonweed, Russian Knapweed, Scotch Thistle, Spotted Knapweed, Yellow Starthistle, Yellow Toadflax. No plant growth, including, but not limited to trees, grass, shrubs, weeds or noxious weeds as defined, shall be allowed on public ways to include public streets, sidewalks and alley ways.
C. Any owner in violation of this chapter will not be issued a certificate of occupancy or a building permit. If the violation is not corrected by the reinspection date, all buildings being constructed by that owner in the City of Kimberly will have a stop work order placed on all current construction.
