6.08.110: FEMALE IN HEAT; RUNNING AT LARGE:
   A.   The owner of a female dog shall cause the dog, when in season, to be penned or enclosed in such a manner as to preclude other dogs from attacking such female dog or being attracted to such female dog as to create a public nuisance.
   B.   It is unlawful for a female dog to be found running at large on any public or private property while such female dog is in the copulating season. If a female dog cannot be controlled by the owner during the copulating season, the female dog may be declared a nuisance and impounded by the code enforcement officer or police department.
   C.   Any person violating the provisions of this section shall be deemed guilty of an infraction, upon conviction thereof, and shall pay a fine of one hundred dollars ($100.00) per offense.
   D.   If an owner is convicted of allowing the same dog to run at large more than three (3) times in a two (2) year period, the dog may be deemed a nuisance and destroyed in a humane manner. (Ord. 608, 2014)
