§ 71.06 RECREATIONAL ACTIVITIES AND PLAY VEHICLES ON TOWN STREETS.
   (A)   Areas where prohibited. It shall be unlawful to use any of the following streets in Kill Devil Hills: NC 12, US 158, Eighth Street (the north side), Ocean Acres Drive, Martin Street, Ocean Bay Boulevard, Prospect Avenue, First Street, Third Street and Fifth Street for any type of activity, exclusive of walking and bicycling, by nonmotorized vehicles or play vehicles as a means of transportation or recreation, as defined below. Any type of activity, exclusive of walking and bicycling, by nonmotorized vehicles or play vehicles on public streets in Kill Devil Hills shall be permitted only within the hours of sunrise and sunset.
   (B)   Definitions. For the purpose of this section the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      MOTOR VEHICLE. Every vehicle which is self-propelled and every vehicle designed to run upon the highways and streets which is pulled by a self-propelled vehicle.
      PLAY VEHICLES. Including but not limited to coasters, skateboards, roller skates, in-line skates, unicycles, sleds or other nonmotorized vehicles upon which a person may ride, except bicycles.
      RIDE. Either wholly or partially sitting, standing or lying upon a play vehicle by a person whether such play vehicle is in motion or stationary.
      VEHICLE, NONMOTORIZED. Every device in, upon or by which any person or property is or may be transported or drawn upon a highway, excepting devices moved by human power or used exclusively upon fixed rails or tracks. This term shall not include bicycles or any device which is designed for and intended to be used as a means of transportation for a person with a mobility impairment, is suitable for use both inside and outside a building and whose maximum speed does not exceed 12 miles per hour when the device is being operated by a person with a mobility impairment.
