§ 50.01 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   ACCEPTABLE MATERIALS. Those materials approved for disposal.
   BAGGED YARD WASTE. Grass clippings, leaves, twigs, small branches, bush trimmings, pampas grass, pine straw and other similar material capable of being bagged.
   BULK TRASH. Appliances, furniture, bikes and other non-prohibited collections which are not suitable, because of their size or character, to be disposed of in a roll-out container or dumpster. BULK TRASH shall include tree limbs and branches and bagged yard waste.
   CONTRACTED SERVICES. Any for profit enterprise that provides any improved or unimproved property or business with construction, maintenance, landscaping, repairs or replacement services.
   LITTER. Any rubbish, paper, trash, garbage, loose debris or any waste container overflow that appears randomly upon a property or within the town right-of-way; or any other matter defined as litter by the North Carolina General Statutes.
   PROHIBITED MATERIALS. Any waste or substance deemed or defined as a hazardous substance by any federal, state or local statute, rule, regulation or ordinance or such other materials that may be identified in this chapter as PROHIBITED MATERIALS.
   PUBLIC SERVICES DEPARTMENT. The Town of Kill Devil Hills Public Services Department.
   RECYCLABLES. Any designated acceptable materials or items which may be reused to maintain an aesthetically pleasing environment through the reduction of solid waste.
   RUBBISH. Any waste generated by the preparation of food, either in home or business, such as paper, food and/or putrescible waste, glass, cans, plastic or natural items and other such materials which are considered to no longer be of any value to the owner and any other waste generated on-site in either a home or a business and is to be disposed of in a roll-out container or dumpster. RUBBISH shall not include any prohibited collections or special item materials or bulk trash items.
   SOLID WASTE. Rubbish, bulk trash or any other materials for which the town provides collection and/or disposal services.
   TREE LIMBS AND BRANCHES. The limbs, branches and trunks of trees or shrubs generated from the normal maintenance of the property of a residential or commercial establishment located within the town and is not in excess of the following dimensions: logs no larger than 14 inches in length nor 12 inches in diameter and branches no longer than 6 feet in length. TREE LIMBS AND BRANCHES shall not include stumps from any site, nor trunks, limbs or branches generated from lot clearing activities upon unimproved properties.
   WASTE CONTAINER. Roll-out containers or dumpsters which have been approved by the town for use upon properties within the town for the collection of rubbish.
