§ 177.01 SCOPE AND DEFINITIONS.
   This subchapter applies to any vacant building or abandoned building nuisance, as defined herein, in the Village of Killbuck.
   ABANDONED BUILDING NUISANCE. A vacant building found to be insecure, unsafe, unsanitary or structurally defective by reason of inadequate maintenance, dilapidation, obsolescence, or abandonment, including but not limited to any failure to comply with § 177.03 herein.
   EVIDENCE OF VACANCY. Any condition that on its own or combined with other conditions present would lead a reasonable person to believe that the property is vacant. Such conditions include, but are not limited to: significantly below standard utility usage, overgrown and/or dead vegetation, accumulation of newspapers, circulars, flyers and/or mail, accumulation of trash, junk and/or debris, broken or boarded up windows, abandoned vehicles, automobile parts or materials, the absence of window coverings, such as curtains, blinds, and/or shutters, the absence of furnishings and/or personal items consistent with habitation or occupation, and statements by the owner, parties in interest, or other persons that the property is vacant.
   INSPECTION AGENT. The Village Zoning Inspector or any competent and knowledgeable person engaged by the village to perform an inspection of the suspected abandoned building nuisance.
   NUISANCE APPEALS BOARD. The Mayor of the village and no less than three members of the Village Council, who shall be appointed to the Nuisance Appeals Board by the Mayor in his or her discretion.
   OWNER. The record owners of the vacant Building or Abandoned Building Nuisance.
   PARTIES IN INTEREST. The record owners of the vacant building and/or abandoned building nuisance and holders of legal or equitable liens of record upon the real property on which such building sits.
   VACANT BUILDING. A building or other structure which is not occupied by its owner, lessee or other person in lawful possession, or at which substantially all lawful business operations have ceased, or which is substantially devoid of content.
