§ 174.31 REQUIREMENT TO TRIM OR REMOVE TREES, PLANTS AND SHRUBS AND ABATE NUISANCES.
   (A)   All trees shall be trimmed so as to have a clear height of ten feet above the surface of sidewalks and 14 feet above roadways, streets, or alleys. The branches of all trees in front of and along lots of lands near which street lights are placed shall be trimmed so as to not obstruct the free passage of light from such street lights to the street and sidewalk.
   (B)   Whenever any trees, plants, or shrubs along any village sidewalk, roadway, street, or alley are found to constitute a nuisance as defined in this subchapter or to not be trimmed as required, Village Council and/or Village Mayor shall notify property owners, in writing, to trim or remove trees, plants, and/or shrubs so that the trees, plants, and/or shrubs conform to this subchapter.
   (C)   If any property owner neglects or refuses to comply with the notice within 30 days of receipt thereof, Village Council may cause the trees, plants and/or shrubs to be trimmed or removed. The cost of such trimming or removal shall be certified to the County Auditor who shall place the same on the owner's tax duplicate for collection in the same manner as other taxes are collected. Such remedy shall be in addition to the penalty provided in § 174.99(A).
