§ 92.02 PERMIT AND DEPOSIT FOR STREET EXCAVATIONS.
   (A)   It shall be unlawful for any person to dig any hole or make any excavation in any public street or alley in the town, unless the person first secures a permit to do so.
   (B)   The Finance Officer shall issue a permit to any person requesting the same upon deposit with the Finance Officer of the sum as the Finance Officer determines to be sufficient as a guarantee that any hole or excavation placed in any public street or alley by the applicant shall be properly filled and tamped so as to avoid settlement of fill material at a later time.
   (C)   In the event any dispute arises between the applicant and the Finance Officer as to the amount of the deposit, the matter shall be referred to the Board of Trustees, and its decision shall be final.
