For the purpose of discharging the duties imposed by this subchapter and to enforce its provisions, the animal warden or any law enforcement officer is authorized and empowered to follow and enter upon any enclosure or lot within the limits of the town to apprehend any animal which he or she has observed to be running-at-large.

Every animal which bites a person shall be promptly reported to the animal warden, and shall there- upon be securely quarantined for a period of not less than 10 days. The quarantine may be at the shelter designated as the county animal shelter, or at the owners' option, in a veterinary hospital within Pennington County. The expenses of the quarantine shall be paid by the owner of the dog. Every owner having knowledge that his or her animal has bitten, or is suspected of biting a human being, shall forthwith report the same to the county animal control officer for disposition of the animal.

(A) Any dog which has ever bitten any person so as to break the skin, to the knowledge of the person owning or taking care of the dog, must keep the dog in a secure enclosure, or the dog must be accompanied by a person who, by means of a leash, has the dog under control at all times.
(B) If this condition is violated, in addition to any other penalty, the dog shall be taken by the county animal control officer and destroyed.
