§ 136.99 PENALTY.
   Any person who violates or assists in the violations of any provisions of this chapter shall be deemed to have committed a petty offense and shall be fined not more than seven hundred fifty dollars ($750.00) for each such violation. Each day on which, or during which, a violation occurs shall constitute a separate offense.
   (A)   A first violation of this chapter shall be punishable by a fine of no less than two hundred fifty dollars ($250.00) nor more than seven hundred fifty dollars ($750.00).
   (B)   A second violation of this chapter by the same responsible person shall be punishable by a fine of no less than five hundred dollars ($500.00) nor more than seven hundred fifty dollars ($750.00).
   (C)   A third or subsequent violation of this chapter by the same responsible person shall be punishable by a fine of no less than seven hundred fifty dollars ($750.00).
   (D)   A person charged with a first or second violation may plead guilty and pay the minimum fines as imposed in divisions (A) and (B) above without a court appearance. Fines should be payable to the Clerk of the Circuit Court of Henry County, Illinois. Third and subsequent violations of this chapter shall require a mandatory court appearance.
