1060.05 CONTAINERS.
   No owner, tenant, or lessee of any residential unit shall permit any solid waste, garbage or rubbish to accumulate on his or her premises unless it is placed and maintained as provided herein.
   (a)   Containers Required. Each residential unit shall be provided one ninety-six-gallon solid waste cart and one sixty-five-gallon recyclables cart. On the regularly scheduled collection day, residents or owners shall place the solid waste cart and recyclables cart behind the curb line in front of the residential unit. All solid waste shall be stored in such solid waste cart and all recyclables shall be stored in such recyclables cart. Any solid waste that shall not fit into the ninety-six-gallon solid waste cart must be placed in a trash bag not to exceed thirty-gallons of sufficient quality to hold the contents contained therein without breaking and be tied at the top or sealed with a twist-tie. The resident or owner shall be responsible for maintaining the solid waste cart and recyclables cart and all such carts must remain at the address where they are delivered. Any resident or owner will be charged a fee of seventy dollars ($70.00) for the replacement of any cart, which will be added as a separate charge to such user's monthly bill. Residential units may request an additional solid waste cart at the cost of three dollars and fifty cents ($3.50) per month and an additional recyclables cart at the cost of three dollars ($3.00) per month, which monthly fees will be added to the applicable monthly flat rate set forth in Section 1060.06 .
   (b)   Bulk Items. Bulk items shall be placed behind the curb line prior to the time of regular collection of the day of collection.
   (c)   Placement and Removal of Containers. No resident or owner of a premises or its agent shall permit the placement of any solid waste cart or recyclables cart on any street, curb side, or public right-of-way for collection and disposal thereof any earlier than 4:00 p.m. the day before the scheduled collection day and such resident or owner must remove said carts no later than 6:00 p.m. the day after the scheduled collection day. Any cart left in violation of this removal schedule will be removed and placed at the front of the residence by City employees. Repeated violations of this section shall be billed a twenty dollar ($20.00) administrative fee per violation to the resident's next water bill. Failure to provide payment of these additional charges will result in termination of water service at such premises.
