§ 51.34  DEPOSIT.
   (A)   A meter deposit will be required on each commercial account, the deposit to be equivalent to 1 month's water and sewer charges; provided that after a 3-month billing period, the Town of Kenly will take the monthly average for the account and use the average as a base for any additional deposit which may be required and will bill the additional deposit to the customer at the end of the 3-month billing period.
   (B)   (1)   All individual residential, business or industrial users or others requesting to connect and receive water and/or sewer service from the town shall first make application for service and make a deposit equivalent to 2 month's water and sewer charges.  The deposit shall be calculated on 2 times the average of the preceding 12 months billing for that particular account.
      (2)   If an account does not have a 12-month history the deposit shall be calculated on 2 times the average of the preceding available months billing for that particular account.
      (3)   With garbage collection being on the same monthly bill the garbage collection fee shall be included in the deposit calculated and required for the individual, business or industry requesting service.
The minimum deposit shall be $40.
      (4)   The deposit shall be returned to a customer who has been on the system for 30 months without being on the cutoff list for more than 1 month.  If a customer has been on the cutoff list 2 or more times during the 30-month period the deposit shall not be returned until the customer leaves the town's system and any and all outstanding bills have been paid by the customer.  The deposit shall be refunded, minus all outstanding bills, after the next billing cycle reflects the final bill has been paid by the customer.  If a customer leaves the town's system without paying the final billing amount and the deposit will not cover the amount of the final billing amount the customer shall pay the difference in the amount of the final billing and deposit before being put back on the town's system at any location the town serves.
