§ 50.03  UNLAWFUL DUMPING OF REFUSE AND GARBAGE PROHIBITED.
   (A)   It shall be unlawful for any individual, partnership, or corporation to empty or dump waste paper, paper cups, magazines, trash, refuse, and the like, upon the surface of the ground at any place within the corporate limits of the Town of Kenly; provided, it shall not be considered in violation of this division (A) if the waste matter be immediately destroyed by burning or by other appropriate disposition.  Pedestrians in the business area of the town shall deposit waste matter in the receptacles provided for that purpose.
   (B)   It shall be unlawful for any individual, partnership, or corporation to dump or throw garbage upon the surface of the ground within the corporate limits of the Town of Kenly, the garbage in this division (B) referring to the type which cannot be destroyed by burning (for example, bottles cans and food).  The garbage shall be deposited in garbage cans, drums, or like containers for collection by the garbage collector.  (See amendment to this section.)
   (C)   It shall be unlawful for any individual, partnership, or corporation to create or allow a condition which amounts to a public nuisance, upon any private property within the Town of Kenly, or any condition which may be detrimental to the public health of the citizens of the town, or to create or allow conditions which create obnoxious odors, and when the condition is deemed to exist by the Town Council, the owner of the property, or the occupant if the same is leased, shall be notified in writing by the Town Council for the owner or occupant to correct the condition within a reasonable time of the service of the notice and the failure to abate the nuisance within the reasonable time shall constitute a violation of this section.
