§ 31.01  USE OF TOWN EQUIPMENT, VEHICLES; TOWN EMPLOYEES ON PRIVATE PROPERTY.
   (A)   It shall be a violation of town policy for any employee to direct or instruct other town employees to work in any area outside of town rights-of-way or easements and rights-of-way owned by or maintained by the State of North Carolina or the United States Government.
   (B)   It shall be a violation of town policy for any employee to direct or instruct another town employee to use town equipment to work in any area outside of town rights-of-way or easements and rights-of-way owned by or maintained by the State of North Carolina or the United States Government.
   (C)   It shall be a violation of town policy for any employee to use a town vehicle to transport himself or herself or people who may assist him or her, or equipment, and/or materials to work on non-town related work projects during regular work hours or off-work hours.
   (D)   Any and all employees who violate this section shall receive the following disciplinary actions.
      (1)   Violation 1.  Any employee found to be in violation of divisions (A), (B), or (C) above for the first offense shall receive 1 day suspended leave without pay.
      (2)   Violation 2.  Any employee found to be in violation of divisions (A), (B), or (C) above for the second offense shall receive 1 week suspended leave without pay.
      (3)   Violation 3.  Any employee found to be in violation of divisions (A), (B), or (C) above for the third offense shall be terminated from town employment.
   (E)   The Town Manager shall be responsible for enforcing this section.
   (F)   If an emergency life threatening incident occurs on private property, town employees and town equipment may be authorized for use by the Town Manager.  The Town Manager shall report the incidents to the Town Council during the first Town Council meeting after the occurrence of the incident.
   (G)   This section shall be effective 11-10-1987.
